  1. Hi All. My fiance received conditional permanent residency through a K-1 visa on March 7, 2017. Thus, the green card expires on March 7, 2019.
  2. Naturally, we filed to remove conditions on her residency (i-751) and received an 18 month extension letter, thus extending her green card's expiration to September 7, 2020.
  3. At the 3 year mark, we also filed her n-400. A while later, we received an NOA that says "We have completed a preliminary review of the application or petition ("your case") listed above. As a part of standard processing, we transferred your case to the USCIS office listed below that has jurisdiction over your case. [etc.]" When we check the case status online, this message is also presented to us: Case Was Transferred And A New Office Has Jurisdiction
    On January 30, 2020, we transferred your Form I-751, Petition to Remove Conditions on Residence, Receipt Number [redacted], to another USCIS office. That office now has jurisdiction over your case. [etc.] Thirdly, when logging in to my fiance's USCIS account online, it says for the i751 application: "We received your case [etc.]" but a wait time is not provided. There is barely any information.
    • I assume this means that the i751 will be processing along with the n400, as I've read this to be the case throughout this forum. Is this the standard language that you all receive if that's in fact what happens?
      • If that's true, I've also read about some users where their n400 appointments are being cancelled because the i751 has not been processed. How can that be the case if the i751 and n400 are processed together by the same office? Not sure if this detail is relevant but we filed the n400 after her biometrics for i751 was completed. That was the last milestone before the n400 was filed.
    • However, when we check on her online USCIS account, it says that the n400 is estimated to be completed by November 2020, which means that my fiance will be out of status from September 2020 through November 2020. Any advice here? Do I have to request another extension somewhere? My fear is the effect this has on her n400 interview or that she won't be able to work during this 2-3 month period (She currently has a job).
      • Can she travel during this 2-3 month period when she is out of status? She is a Canadian citizen if it makes any difference.

Wrong part of the forum. You might get a better answer if you post on the ROC or Naturalization forums. 

 

She won't be out of status. Expired green card doesn't mean she's not a resident anymore. It just means the card is expired. I think she can just try to get appointment to get her passport stamped.

If you are married, she is not your fiance...........

 

Her status does not expire when the extension letter expires.  Her status as a legal resident remains intact.......only the proof of status will not be current.  If she needs to travel, she should make an emergency appointment and get a stamp in her passport.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Oh man... Terrible mistake. I've been reading a lot of posts here about folks and their "fiance" and I guess I just picked up the word. Thanks for catching my mistake.

There are thousands of people in your situation, tons of them on this very forum even. Check the ROC subforum and you will find threads for every month, check your particular month and you will see people still waiting. In other threads you will also see people waiting whose extension letters already expired a long time ago. 

 

Like others have already said, it's the proof of the status that expires, not the status itself. If you need proof of your status for work or international travel you can call USCIS and see if they allow you to get an infopass appointment to get a stamp in the passport. From what I understand most offices are closed for this service still due to the virus, and you can  only get a stamp if it's a real emergency. You can also not get a stamp if you have more than 30 days left on your extension letter.
