Can't say getting married would fix every issue, especially if you're relying on a consulate for renewal, I dunno how that works, or if it would make renewing an L harder for other completely separate reasons. But it's something to consider.

I did AOS from L1A.  It was painless as L1 is dual intent.

I don't deal a whole lot with L visas, sorry. I know what they are and when they apply, but specifics are something I generally refer back to the company's immigration attorney because they can provide actual legal advice.

 

If it results in a new visa, I would expect it to be covered by the EO.

Alternatively, one can do an Extension of Stay (EOS) within the US via an I-539. This should not be covered by the EO. The only issue is he can't leave the US and return...he needs an actual visa for that.

I think geowtian is correct.  Can apply for an extension from USCIS should be okay, but you can’t leave and get a new visa stamp.  
 

So your stuck in the US.

I guess the real question is what happens when folks travel abroad with expired H1, L1 visas to get a new visa from categories like H1,L1. Will the embassy deny based on EO or will they grant visa provided no other issues ?

Sounds really risky to me. I wouldn’t risk it given these rules are influx.

We can live with stuck in the USA! We were just concerned with there being a gap between when his L1 authorized stay was up and approval of the EAD he would have in process through adjusting status if extensions are affected. Still not sure but my reading around over the past day seems to indicate that we are going to be fine. We wait for word from HR/legal on this. It's really just a money thing for us at the end of the day, so I have less to complain about than many people.

Yes. All IVs except those exempted (i,.e. spouse or child of a USC) are banned.

This is an extension and expansion of the April EO. It will last through at least the end of this year. It may or may not be extended again.

Hi, My Parents who had their interview done in January and already have their IR5 Visa were planning to immigrate for first time in USA . Are they affected by the latest ban since they already have their VISA approved?

 

They are coming from India and international flights are going to open in July. Their 6 months to travel to US from approval expire on July 23rd.

If they already have the visa issued, they're fine. Just don't travel through (stop at) a country with a physical presence ban.

If they were only approved at the interview, the visa can no longer be issued until the ban is listed.

It wasn't 100% clear whether they already had the visa in hand or not.

I think H1B visa needs to be re-evaluated and redone entirely. I don't support anything when it comes to Trump's radical ideas and the reasons behind them.

But H1B should not be seen as important to move (to any country for that matter) just for work vs. let's say asylum and political refugees, family/relatives, spouses, etc. H1B has been abused. I work within the IT sector and the H1B workforce is many times payed half the money the expertise, responsibilities and the long hours demand. That puts stress in the economy for the domestic IT experts who have to lower their salaries to meet the market. That is damaging on the long run, as less people will want to work in IT and re-educate or do something else entirely instead, since the profession will not help them pay off student loan debts and begin a new life and career on top of it.

 

In other words it's killing the IT industry (and other industries).

 

You can call it modern day corporational slavery. Unfortunately, it took a person like Trump to do something about it, again.. for the wrong reasons, to see results in that. Let's hope a more serious administration in the future picks that up from there and does something good out of it... more controlled, checked and a more reliable system that doesn't stress the market and demands on our IT experts.
