Hello,

My question is current income related in i864. My parents have filed for their daughter and her family, and in i864 in current income is where I'm bit confuse. My parents have recently started business, so they did not have any profit, but this month they started getting profit so in current income if we make prediction on how much they will make, they won't be able to show a lot of evidence other then 1 paycheck which they will pay themselves because its their business. Is that sufficient for evidence?

Also, we have a Joint sponsor because my parents didn't have much income in past 2 years due to new business, so the joint sponsor has enough income to support, so I'm hoping it doesn't matter to them on how much my parents current income is.

@pushbrk Can you help please? Thanks.

For self employed business owners, there is no "current income" until after it appears on a tax return.  Unless your parents have another source of income, their current income is zero.

Also, if you have a loss income, how do you enter it in i864, it won't let me put minus sign. Should i just keep it without minus sign, because the tax return should let them know that its a loss of income?

If you are talking about prior tax returns with a negative total income number, just enter the number as a positive number, then hand write the minus sign or parenthesis around the number.

My father gets social security retirement, is that count as a source of income? can i put that in current income, or does it look bad as current income because it would be very small number?

Big, small, medium.  His income is what it is.  Yes, Social Security is income and is put in the current income space, no matter the amount.  Document it with a current SS declaration letter that can be downloaded from socialsecurity.gov

Got it.

On NVC site i found this: If you filed jointly: If you filed taxes under the “married filing jointly” category, you must also submit your Form(s) W-2 or schedules(s) from the most recent tax year.

My parents don't have w2, but they have schedule k-1 is that what they mean?

Also, if my joint sponsor has sufficient income, does it matter if petitioner shows asset since their income was showing loss for 2 years?

A complete copy of a tax return will include everything that would have been mailed if they filed by mail.  Their tax advisor can advise them as to exactly what constitutes a complete copy of THEIR federal tax return.

@pushbrkAnother question related to public charge. My father has applied for my sister and her family, he has medicare part B and A, so he is not public charge, but my mother gets tax credit for insurance, in the tax return it shows premium tax credit but it doesn't specify whose receiving it, since they file jointly. Does he have to clarify so they don't think he's the one whose receiving tax credit? If so, where to clarify.

Thanks,

I'm not sure if that's how public charge work. I was reading and it says public charge means they will look at the one who is immigrating or Do i have that wrong? do they look at the petitioner too? In my parent's case only my mother is getting premium tax credit not my father, and my father is the sponsor so if they do look at the petitioner, not sure how do they determine that my mother is receiving tax credit not my father.

Thanks,

A person in your father's household is receiving a tax credit.  It really doesn't matter which person.  However, based on your father's age, they will know it is his wife.  The public charge concern is about a judgment call regarding how likely it is the immigrant will become a public charge.  However, the  Consular Officer is trained to consider the totality of circumstances.  One of those circumstances is WHY your mother is receiving a tax credit for health insurance.  That REASON, is related to household income, so may or may not be CONSIDERED.
