Petition to include K1 filers as exemption from travel bans

Timeline

My fellow spousal Visa beneficiaries and petitioners, please let's come together and enforce a petition too. The pain of separation and the herculean strain and length of the visa processing is overwhelming. They should consider our plights and shorten these processes for a limited time. The onus of proving a a bona fide marriage still lies with the beneficiary/petitioner. Somebody help us create a link please.

I honestly don’t request any equal right, but as other family members, would want to be exempt from the travel ban. As far as I’m concerned that’s the goal of the petition they have created, and that’s enough.

And by the way, I see how the government doesn’t recognize K1s. A fiancé visa is not a recognition, in your opinion. And then what is it?

I have read the whole EO and it allows for the exemtions of spouses,  children of spouses,  those with an approved visa,  medical visas,  

and leaves out the K1

This is just an opinion ( mine) but i would think the best way to stop the way things are going down (so hard to say what i want and not offend anyone) is to vote and encourage the new citizens to register and use their new rite to vote to voice what they believe in

as republican senators wrote about the original 9984 expressing their own disapproval and their plea was ignored .  

 

So VOTE please and let your present Senator and House Rep know of your agreement or disagreement with the EO

I, myself ,  have been through the system (K1 denied ) and the CR1 (denied ) and finally IR1 approved so i am preparing my own letter and info about legal and illegal immigration and some of the things which are big issues (in only my opinion) and will send it when complete to my Senator and House Rep and vote in the November elections for the best person that will work to really change things

Received and Paid AOS: 9/15/2017    AOS payment cleared my bank: 9/19/2017 (still shows In Process on CEAC)

Received and paid IV bill: 9/19/2017    IV bill cleared bank: 9/21/2017

Requested Expedite: 9/20/2017

AOS and IV show as paid: 9/23/2017

DS260 unlocked: 9/23/2017

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

Great! then you don't even need a petition, they'll just do what you say.

Absolutely, but as I was told it was not correct, then I suppose the DS uses incorrect terms and classifications in their opinion, obviously.

I'm not saying it's right, but it's how an old out of date system works.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have been guilty of this and on reflection it was an unfair comment, I appreciate that guys with a hell of a lot of experience are here to answer questions on the forum and you are absolutely right in saying its not a competition for biggest loser, please accept my apologies for my past comments of this nature.

(only this bit was meant for you I carried on replying below to the general topic of this thread.. I just saw you and thought I should apologise)

 

Lets just assume that everyone is here because they want to help, sometimes it may not be the answer you want but better to have a correct unpalatable answer than an incorrect positive one.

 

Its also not IR1s vs K1s..  We are all here for the same reason, just using different methods to get there.  Yes I also agree the way K1s have been treated by the EO is unfair but at the same time its also right that they don't have the same legal rights as married couples, that's the same everywhere because lets face it if fiancés want to leave each other they can just walk out the door, they have yet to enter into any legal and binding agreement like marriage, I am not saying your relationships are not as valid as married people, just in the eyes of the law everywhere in the world this is the case.

 

Anyway I just hope this is resolved for everyone asap, we just need to all hang on in there and not tear each other apart

Honestly, even though it may not have been articulated in the correct way, in my opinion the intent was not to say that they are always recognized as immediate family, but are considered that way in, for example, the DS, and therefore could be excluded from the ban.

They have created a petition and it can be redone and modified, obviously. The ultimate goal is always the same one, to be able to be exempt from the bans, as other family members are.
