Healthcare workers getting expedited EAD

Hi everyone,

I was looking at all the different reasons to expedite our case and EAD (once we get to that stage)- would being a healthcare worker (registered nurse and registered paramedic) be reason enough as I would be able to assist with COVID19? Would that fall under the "Compelling government interests?". Just looking at different options.

Thanks 🙂

Thread is moved from the IMBRA subforum to the K-1 Case Progress subforum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I used the "search" box in the upper right-hand corner, and I was able to see many articles concerning your topic here on VJ. It's an amazing tool to use. Here is one such topic similar to what you are asking.

For USCIS processing of the K1 - no not really.  If the CDC or another government agency or department needed you then USCIS can help move you thru.   Once you get to the US you can ask to expedite the EAD by having a job offer.

No harm is requesting it, but I would not expect a favorable decision here. Hope for the best but expect the worst.

An expedite would be needed to get a quicker consulate interview as well (or an interview at all if they are still suspended with routine visa processing).

Then you would need to enter the US and marry and file for AOS. And then expedite the EAD...generally biometrics are required first so add around a month there as well.

Just be aware that even in the absolute best case at every stage of the process, you're talking several months at a minimum.

One of those where CR1 would seem a better option.

I would be happy if I could get my EAD expedited once I get over there, I'm sure a workaholic I'm not sure how I am going to go not being able to work for a bit haha. I have accepted that it's apart of the process though.

I know :( original plan was a CR1 but my partner changed his mind and wanted to do the k1 as I would get over there sooner, hindsight is 20/20.

One thing you could do as you wait is look into licensure/foreign education requirements for your US state's board of nursing.

Good luck. It is a national exam.  I found it to be a breeze compared to the exams in nursing school.

Thanks. I hope so, I get so nervous with exams. I'm still learning how to use Fahrenheit and getting used to how they use mg/dl instead of mmol for their BGL's but I'll get there 🤪

Luckily, many employers use Celsius and kilos and meters/cm, and all drugs are dosed by mg/g!  For the labs, it is often just a matter of where the decimal point goes.
