He would also have to reimburse the state for any payments made when he was unavailable for work.  I have heard of cases of garnishment of huge sums of money, years from when it was paid out.

It all depends on the state, right now here in Nevada the work search requirement is still suspended for now. Governor announced a week ago it would be extended until revoked ( No idea when that will be), but as it is right now, you can just collect and not look for work, but not sure on Florida. when you file your weekly you just bypass the work search page, and I know it has been working for my friends that are on it right now.

CARSON CITY — Unemployment insurance filers will continue to be afforded the work search waiver until further notice, Gov. Steve Sisolak and the Department of Employment, Training and Rehabilitation announced Tuesday. The move aligns with current guidance from the Department of Labor.

“Continuing to waive this requirement maintains Nevadans’ access to unemployment insurance benefits while Nevada gradually reopens with new safety precautions in place for workers and customers,” said Gov. Sisolak.

“While some businesses are starting to reopen, we continue to see the unemployment rate rise and it makes sense to keep this measure suspended to assist Nevadans in continuing their unemployment insurance benefits, ” said DETR Director, Heather Korbulic. “Our agency will continue to work with the Governor’s Office and the Department of Labor and other federal partners in moving forward as we support families throughout Nevada and participate in the reopening of the Silver State.”

To comply with federal law, weeks beginning May 10, 2020, claimants will be required to return to the CONNECT system every two weeks to request their benefits or “claim their weeks.” In so doing, claimants will confirm that they are still unemployed and acknowledge that you are able and available for work.

You must claim your weeks in order to receive benefits. Claimants will be able to request a benefit payment for each week available.

Governor DeSantis has, however, directed DEO to waive the work search and work registration requirements for claimants through July 4, 2020. However, answers to work search questions are still required to process your claim in the CONNECT system but will not impact benefit payments.

All new claimants should visit www.FloridaJobs.org to file a claim for Reemployment Assistance.

 

So one must still file a claim for the weeks even if they do not qualify for benefits that week, just to certify that they still qualify for UC.

Surprised you asked this as your May post says this about you

 

Hey guys..I just got back in the USA, 3 weeks ago after 11 months overseas ( Im a green card holder and CBP did not give any warning or anything ) I was overseas because of a few medical surgeries, and unfortunately Im not feeling really well, I talked to my doctor overseas yesterday and he told me that I really should go back there to do a new quick procedure

 

How he is able to get it when not under normal circumstances?   it is the governor who is doing this under the PEUC in the best interest to get Florida back to work

As far as the unemployment insurance part,  most states require you report 2 places (in the US) that you have made applicaitons to to keep your unemploymewith  coming in 

and reporting this is usually done online with names and addresses of those companies for which you have made applications (for 3 weeks) with an in-office to Department of employment once a month to show in-faith trying to get a job.    Understand anything (because of the virus) can change at any time but it is going to take a long time for normal to return

oh I see!

 

its because people from my country ( like me ) think that we can have the entry in the US denied for any reason lol

Only USCs (and very, very limited other groups) are guaranteed entry. But as an LPR, there would need to be something very significant to deny entry, like smuggling, national security, etc.

 

Technically, if he were to make a false UC claim then that could be a criminal offense. It may be considered a CIMT and could make somebody deportable. If all that were to actually occur while he was gone, he would likely be detained by CBP pending hearings.

 

Practically, there is almost zero chance of them doing anything more than freezing his UC account once they see that he made a claim while abroad while they do an investigation. From there, they will determine if he violated the UC program provisions, and if so, the consequences for doing so. Criminal UC fraud seems unlikely to me (but not impossible)....more likely if they determine he knowingly violated UC then it would result in repayment of anything improperly received (directly, with a payment plan, or with garnishment to wages or via withholding a tax refund as necessary) + being ineligible for any future UC benefits.

That process takes months to even years.

 

Also note that even if not not criminally charged for UC fraud, it can be held against him for naturalization purposes due to not meting the Good Moral Character (GMC) requirement.

 

Again..the best thing is for him to file the claim while abroad while declaring he is unavailable for work. He won't get money for those weeks, but that's much better than the consequences for a false UC claim.

The US records the entry and exit of all aliens. They can (and have) linked up records. it takes time, but that just makes the punishment worse (more repayments).
