K1 Visa Issuance Affected by EO after all?

I had my medical last week and everyone there said the embassy had told them they’d open in early July, so it’s a bit disappointing. Do ask the staff there if they’ve heard any further updates as the embassy don’t seem to release any information!

Not surprising, since the COVID situations regionally are rapidly changing all the time.  Lots of states here in the US projected (using politics vs science) that by this time the virus would be well-controlled, so they reopened and are now seeing higher numbers than ever.

I rescheduled but there was nothing for August so I've booked a slot in July just in the hopes that they'll open (Not very hopeful), if not ill be keeping an eye on openings in August ! I  had my my medical in March.

Disregard my last comment here, I'm suddenly unable to make another appointment again. Looking at what other's are saying here, I guess I'll just wait until the end of July to see if any are available. London is quite a distance for me so my main concern is that I'll turn up to an appointment and be turned away or it won't be open when I arrive because things keep changing.

 

I'm honestly just worried about waiting too long and the whole thing becoming invalid, but am I right in saying all I'd need to take is a letter of intent to marry (still) to prove we want to go ahead with the process? (I'm sorry if this comment isn't very fitting for this thread)

I managed to get a July 6th appointment again after all the cancellations on Friday, just went on to see if any more days had opened up in August as I don't have great faith that the July appointment will go ahead, No appointments available but July appointment hasn't been cancelled,  what a mess this is, so confusing lol !

 

Fully expecting my appointment to be cancelled in the week. 

 

As for your last question I believe London embassy renews your petition at the window during the interview and all you need to take is a new up to date letter on intent. (someone correct me if i'm wrong)

Just a thought, please don’t bite my head off if you think it’s completely stupid. 
 

With this new EO set to be signed today, it now lists non-immigrant visas that are banned until the end of the year but K1 isn’t on the list... could this work well in our favour ? Or do you think we’ll just be brushed to side (again) ?

While I would love to be hopeful, i do not think that they will be processing K1 visas, as Trump's intent is to limit the distribution of green cards in order to 'protect American jobs'. The K1 visa only gets you into the country to get married, then you need to apply to adjust your status to get your green card and authorization to work in the country. I honestly cannot imagine that he would be willing to let anyone get in the way of his beloved economy. Ugh.

 

Again, I could be wrong. My fiance is in Sweden and his i129f approval expired June 3rd and we needed to request an extension, which is now good until September. So i am banking on needing to submit another extension.

 

Im so sorry for what everyone is going through

Read the new PP: https://www.whitehouse.gov/presidential-actions/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak/ It doesn't ban K-1.

Apologies should’ve been a bit more clearer. London embassy believe that K1 comes under that PP, they had cancelled all K1 appointments in for July and claimed it to be because of the PP (confusing because it doesn’t state anything about the K visa in the PP).

Correct, but London embassy had sent an email stating it was. I think every embassy is different. 
 

 

@HRQX apologies again lol didn’t realize the new PP was already released. Thanks for that !

The PP explicitly states that H-1B or H-2B, J and L visas are suspended but i think the issue is that it also states this:


"The consular officer shall determine, in his or her discretion, whether a nonimmigrant has established his or her eligibility for an exception in section 3(b) of this proclamation"

 

So this is maybe why the London embassy is interpreting K-1 visas as also suspended under this PP, as @Ah96 said.

 

Unfortunately for all of us, I think we're at the mercy of the consular officers 😟
