Bringing my widowed mum over

Hi All,

I have had a look at visajourney about bringing family over to America when i go, but i can't find the answer about my mum.

She is widowed (many years ago) and now engaged with her partner.

My only sibling (my brother) is in America already, he did the K-1 visa last year, so he is not a perm resident yet for another 2 years, which I believe my mum can't apply until he is a perm resident. I am at present going throught the K-1 also!

If anyone can answer any of these questions below, that would be great!

Does my mum have to get married to her partner in order for them both to move over, they have been together over 5 years.

  • When should she start applying, if it takes a up to a year to apply like the K-1 does, is it better to start soon?

Is there any rules on her being able to work when she get's there?

Apparently pack 3 was today signed for after going into a PO Box! - Aug 3rd -07 (9 days late)

So far 21 weeks


Pack 4 turned up! Interview end of August! - August 9th 07

Interview - 31st Aug 07 -Approved!!
27 weeks and 3 days from start to interview

Your brother would apply for your Mum, but only after becoming a US Citizen, he needs to be a Naturalized US Citizen befor he can apply for a parent. He would file form I-130 for your mum and her future husband.

I believe he could apply for "step dad" also as an immediate relative, no length of marriage to your mum required.

Processing time is similar to CR-1/IR-1 spousal visa, so a bit longer than K-1 visas.

If and when she immigrates on and IR visa, she would be issued a green-card and can begin working almost immediately.

You can only file for a step-parent if they became your step-parent before your 18th birthday....

You or your brother would have to be a USC to file for your mum she would then have to be approved and move to the US, then she could file for your step-father as a LPR...

Makes sense, and it sounds like a LONGGGGGG time to get them both over.

Your mums partner is a USC?

Rules on work are dependant on arrival status (ie.. visa type).....

Probably 4 years for you Mum to arrive, say 10 for her partner assuming they marry.

Do they have any other options, job transfer?

Also depends on their age, dreaded health insurance.

If your brother's AOS has been approved, then he IS a permanent resident. It doesn't matter if his residency is conditional. People tend to underestimate a conditional green card for no reason - it's just as good as an unconditional one.

However, your brother can't file for a parent until he becomes a U.S. citizen anyways...

He can petition her once he becomes a citizen.

Her "partner" cannot be petitioned unless they are going to eventually get married...and that will take a while as well.

It is possible if:-

1. you or your borther become citizens

2. You or your brother can then petition for her to come over

3. If she is married to her partner then once she is here and has her Greencard she can then file for her husband...

You or your brother can not file for her husband as the marriage that forms the step-parent relationship did not happen before your 18th birthday.... your mom and her partner would have to be married and it would take a few years for her to get her then husband over here....

I am new to this forum chat and didn't realise anyone had responded, until i looked up my threads!

Thanks for all the replies.

I kinda get the jist that we could get mum over on a visa once we are citizens but cause she would be married to her partner, that doesn't mean he would automatically be able to come too right?
