Unfortunate problems

Hey friends how y'all doing? My husband not long ago removed his condition and lost his wallet containing his perm GC. he tried to help his fellow country man who landed him into trouble and bc of that he got put on probation. My question is will he be able to file for a replacement GC or his arrest record will stop him from getting a replacement GC?

He needs to apply for a replacement card. Did he file a police report for the loss/theft of the original card? 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

Do they run a background check for an application for the replacement of GC? It is not an application to approve a new immigration benefit, merely to replace a document for a benefit already granted. So the question is will they run a background check? You may get an hourlong appointment to consult with a lawyer to get the answer to this question. Even running a background check doesn't automatically mean a bad outcome.

I think they do bc they asking for the ap plication fee and the fee for biometrics.

1) biometrics  does not equal the USCIS doing a background check.  It is to update the photo and make sure the person applying for the replacement is the immigrant.  They may not even do the biometrics but you pay the fee regardless.

2)  He is required to obtain a replacement green card - so let's not break that law too.

3) USCIS can get a new background run at anytime.

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved

He is not renewing his greencard (where his arrest will come up) he is merely reporting it stolen and obtaining a replacement. You don't need to be scared. An immigrants green card is pretty necessary.

Okay, thank you Luckycuds. U absolutely right, bc he can't get the type of work he want to right now without the GC.

Correct- can't work, travel or have proof of his legal status on hand. 

Just tell him to stay out of trouble, leave his fellow coutrymens problems to themselves and follow the guidelines of his probation.

Please make him update his SS card after he gets his new GC. Using SS card + driver's license is an alternate way to establish proof of work authorization without having to reveal your immigrant status to the employer.

Yes he went to the SS office to get his SS card and they said he has to come with his GC. When we get the replacement i will remind him to go for his GC. Thanks Kline19
