DS-5540 Questions

Hello everyone, I was wondering if any one can help me out as I have a few questions with the DS- 5540 for my CR-1 visa

1.Do I even need to fill it out as my priority date is Dec 20, 2018 .

2. If so, is this questionnaire based solely on my wife (beneficiary) information or does that include me (petitioner). Such as question 9 regarding income, my wife doesn't officially have a job in the Dominican Republic she did work as a secretary before she gave birth to my step daughter 4 years ago but they terminated her as she couldn't work after giving birth. So can I include my income or should I just $0?

3. Likewise with question 10 regarding debt. She has no debt either here in the U.S or in the Dominican Republic should I say $0 or should I include mine which is significant as I owe student loans and for a car but my payment history for all my debt has been 100% for a very long time.

I have a few other questions but I believe I maybe be able to answer them once/if  I get advice on any of the questions above.

I'd fill out a DS-5540 for her.   It is now being collected at the NVC - started in Feb as I recall.   All the questions relate to her - so yes her income would be zero and if you don't live in a community property state, her debt is zero.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I submitted everything to the NVC and then received a DQ now I am just waiting for a interview appointment at the embassy in Santo Domingo. I didn't see the DS 5540 on the CEAC but I want to make sure it is filled out just in case. I live in Massachusetts so it is not a community property state so I am not really sure how that would work because it says the family courts considers how everything is divided.

I am also confused about DS5540, we've submitted all civil and financial documents on February 08th, we got DQ on April 22nd, but NVC didn't ask about this new form (DS 5540) should I upload it on CEAC even after DQ? Or should I just fill it and present it to the embassy officer the day of the interview.

Timeline

The way I read the form in the literal sense and per other threads here is the document says "assets that are available to you".  It does NOT say to list "your assets".   I consider my assets available to her for her use so I listed them.  I haven't yet gone to interview yet.

Yes, the information on the form pertains to your wife and needs to be filled. I uploaded mine to CEAC after being DQ and will take it to the interview. If she has no assets, then I believe you put in $0; same with liabilities.

did you get an email from NVC requesting you to upload DS 5540 or we can do it anyway?

No,  I had been DQ by the time the new rule was passed so I uploaded it anyway under Additional Documents
