Hello! I am looking for someone to clarify a question that I have seen mixed answers to in multiple places. My wife is in the NVC phase of processing her visa while my son and I are American citizens, and we all live in Monterrey Mexico. We would like to fly and visit my family for a month. I have read sources say that a spouse would not be allowed to visit on a tourist visa because they have already expressed intent to eventually immigrate, but I have also read that a spouse can get a tourist visa if they have proof they will return, such as being signed up for school or having a job. My wife has proof she's enrolled in her last year of university, a letter of intent to hire from her internship this fall, and our current rental agreement. Is there anyone that can give me a definitive answer about this? Thanks!

No   it is up to the CO at the embassy

In Brazil they denied a high school teacher who was coming to see  family and her husband was a police officer 

and she was traveling in the off school time alone leaving husband and 2 sons 

had proof of owning apartment and of course,  her years as a teacher and family in Brazil to go home to

 

Co can approve or deny anytime or any day

but she has immigrant intent so "go figure"

I have read about things like this, but I have seen a lot of cases as well as people that went to visit in the US without any issue. That's is whats making this whole thing so confusing.
