Hello fellow vjers, i have another question. For the documents to be submitted in the nvc, does it need to be original? Or just a photocopy? I am just confused if it should be original or not

Like the foreign spouse's police.clearance and termination of marriage and so on. Thank you guys in advance.

and bring the originals with you to the interview.

Thank you. And one more question if you dont mind. (By the way this case is not mine, just helping a friend😁)

for the income tax, the us citizen was still married for the yr 2016-2018 so they filed jointly. Now the questions is, for the nvc(with his new wife) should he just put the income that they made together with his ex wife or its just his income that he made during those years?

if the irs tax return transcript is for a married filing jointly, he will need to provide the w2 and any 1099's that are for his income (vs his spouse).

and only put their portion of his income as the income for those years.

I agree on the first part.

I'm not sure about the second part. You would think that putting your portion of income makes intuitively sense, right?

However 864 clearly tells which values to enter (Total or AGI) from tax returns.

The following quote is not mine but might help (13a-c has probably changed since)

Quote

The I-864 in Part 6, line 13a-c, asks for the sponsor’s “total income…as reported on my federal tax returns for the most recent 3 years.” This is where you need to take the income reported on line 22 of last year’s 1040 and put that figure in line 13a. Don’t worry that this figure may be joint income and much higher than what was reported on line 5.  It is just being used as a benchmark.  A lot of practitioners over-think this question and try to indicate only what the sponsor earned last year.  The NVC will return the I-864 if the reported income on the tax return is different from what is indicated in line 13a.
