Issue with boyfriend visit during TN renewal?

Hello,

My boyfriend is from the US, and I'm mexican, currently working on a TN Visa. He has come to visit me in Mexico 3 times, during his 2nd visit I had my TN renewed. We didn't have any immediate plans or clear intention to get married at the time. I've also visited him a lot of times in the US. I've been in a relationship for over a year now.

Right now we are looking at options for us, and in the K-1 visa requirements, there is "Evidence of meeting in person", we wonder if we decided to file for the I-129F (K-1 Fiance), is there's going to an issue with my TN renewal date being during the same time as one of his visits.

Can you please clarify what a TN visa is? Are you working in the US?

There is no issue unless you file for TN renewal after filing AOS . Renewal for TN will become a problem once AOS is filed. Also you cannot leave the country once AOS is filed until you receive AP and cannot work if your TN Expired and EAD is not approved

Thanks. My TN visa will expire in September. If we file for the I-129F before that, since it takes months to get approved, would I still be able to renew the TN in September?

My work also requires me to travel back and forth between Mexico and USA (I work on projects, and I go home for a weekend every two or three weeks, although with the current pandemic, I'm working from home in Mexico).

TN visa is a temporary work visa available for Mexico and Canada (is a non-immigrant intent visa).

 

 

your best bet is to file for consular processing of your Green card. by this way you avoid any possible issues that might arise as TN is non immigrant intent. Opting for Consular processing shows that you intent to depart as per TN non immigrant rules and reenter using your Green card.  You have options

Are you are referring to filing for the I-130 (CR-1 Spouse), after getting married outside the US, correct?

So, Is it possible to renew the TN after filing an I-130?

If so, would there a problem traveling to/from Mexico/US on a TN, while waiting for CR-1 interview and Green Card?

 

And now we are also struggling with the covid-19 risks of traveling, we haven't planned any visits since the pandemic started, to avoid risk of infection.
