hi

so I finally received response from my congresswoman about my I-485 form.

long story short, my VAWA was approved in March but never received online update about I-485 getting transferred to my local office.

 

the response from them was " We received the file from the Vermont service center on 7/6/2020. The case is ready to be scheduled for an interview by the filed local office".

My congresswoman said that she contacted the local office as well and is now waiting for their reply.

 

So this means that my case is at local office, correct?

It says it right there in the response that the file is in your local office! Congrats and goodluck!😊👍

I have updates finally!

 

Recap: I485 pending. Filed I360 May 2019. Applied for EAD renewal Mar 2019 was given 180 days extension (even though EAD card expired), applied again in Nov 2019 - same thing 180 days extension.

 

Contacted congresswoman last year - USCIS responded that its not above processing time. 

 

AR-11 filed in Mar 2020, timeline updated. Sent some more evidence with another request for ead renewal, and also requested for another PF since they didn't send a new one in June 2020. Received a new PF for 180 days (dated in June but received exactly a month later. Was addressed to my old house 🥴)

 

Contacted congresswoman again last week regarding EAD and address update. Days later congresswoman updated that case is currently being adjudicated and I should receive updates soon.

 

Today I received this notification. 

 

I have been worried sick to my bone!

 

Reading all your posts has been a blessing and a comforter. Thank you to everyone that shares. Not there yet but getting closer finally

Hey VAWA family, 


How are you you guys doing? I hope all is in the best health at this time as health comes first. Right?
 Been quiet because I’ve been stressing. My VAWA attorney told me I have to fight against an annulment. Now this other attorney told me to leave the annulment alone and let it default. Then use it to show how my husband is just mean towards me. The other attorney also said if I fight it, and have to testify, then USCIS can look at both my husband’s and I testimony then decide who to believe. I’m here not knowing what to do.

You certainly want to fight the annulment. While not necessary a factor for VAWA, the Adjustment of Status based on a marriage that doesn't exist on paper will be hard.

question... I had my interview scheduled back in April, but because of the Pandemic, got cancel so I have not heard from them since the reopening back in June, I am waiting for the interview re-schedule. 

Should I contact my congressperson?

Since it was cancelled because of the pandemic, I doubt they'll do anything since obviously the pandemic is still very much around! However you can contact them to be reassured..maybe they'll just approve the petition without interview..who knows? That's my prayer for all of you waiting!😊🙏

My answer is still consistent as ever..we've discussed this before and I told you an annulment will have an adverse effect on your petition in the long run..maybe not at the VSC end, but the i485 at your local office! On the other hand, there might be a possibility that your spouse is just trying to scare you and may not have any intentions of following it through...but it's always better safe than sorry. Fight it if he brings it on!👍
