Hello my good family, I'm a 2018 August filler but no approval yet and no Work Authorization since then. My attorney filed work Authorization twice but I dont have it yet . Today I discovered that he filed I-765, Application for Employment Authorization  INSTEAD of I-765V, Application for Employment Authorization for Abused Nonimmigrant Spouse. 

 

MY QUESTION: Do I need to reapply again or I should wait for my vawa approval may be work Authorization will come after approval. Please I need help. Thanks 

 

 

 

The I-765V is just for abused spouses of  who has or had  an E-3, G or H visa. If you don't have any of the visas I mentioned here then your attorney has to file form I-765. If you have a pending AOS he should file  form I-765 category C9. He probably filed with the wrong category( C31) and because of this you didn't receive the EAD until now.

Hello,

 

Hope everyone is holding up well. 

Does anyone know what month Dallas FO is processing? I see lots of interview waivers and approvals for employment based aos. Wonder if we are held up because of the requirement for interviews.

 

I filed AOS separately in Nov 2019 after Vawa approval in Aug 2019. My case was transferred to NBC and no updates after that. If you have any information pls share. Thank you.

If they schedule an interview then let the office know if they can hold your i-485 then you do not need to refile. 

I am collecting all the required documents now and started going to a therapist. I tried to avoid going and was in denial for all these months but now I am kind of forced to do so. It is really hard. I cried yesterday during the first session and it is horrible. But anyways, I want my case to have sufficient documentation so I'm doing all this.

If anyone had their VAWA interview, what do they ask? 

 

Also, I've been reading that some people had pending annulment from their spouses. If VAWA is already approved, can they still deny you during the interview? Basically, annulment is always bad, independently of the stage you are on with the VAWA application?

An annulment proves there was no marriage! Now if there was no marriage how do you prove good faith marriage? This is the reason annulment should be contested with everything in your power! It can snatch victory off your hands if it follows through. Also for the i485 interview..as VAWA has no interview, you may be asked anything at all..so be prepared! Some of us weren't asked much..some officers want a recap of the abuse which they aren't supposed to touch..as VSC already adjudicated that..but then you never know..you'll be asked about your current marital status..questions on the i485 form..good faith marriage..etc..Just go prepared like I said. I didn't have a tough experience just went in and out basically. But I went prepared! Just in case...😊👍

Thank you! And how easy it is to get an annulment? Of course they could just go in and say that they were used for GC or anything really to make our lives miserable.

Many Thanks @Sandranj . He filed form I-765 twice with category C9 and sent to Vermont but i dont pay for filling fee because fee waived . he asked me to come to his office tomorrow. Pls tell me most important parts of the form, so that i will let him know. Thanks

It's not easy to get an annulment. If you're in this situation, please talk to a divorce attorney! Most times they mention it only to threaten you..they almost never follow it through!💁

 Three immigration agencies have authority to issue advance parole USCIS, CBP and ICE (court hearing)  this is what the Law states about who can grant parole, but the Law states  who travels while in removal proceedings will not be able to reenter as well.The person can be paroled into the U.S but the INA Law precludes the person to adjust status.

He is an attorney he knows everything about the I-765 form.

Hi! quick question: how were you able to know that your case was actually transferred to NBC? did that show up as a status on your case?
