Hey folks!

I have a lady who had filed VAWA year ago.Β
Now she is going to divorce but her attorney said she cannot file agreed divorce and she need to divorce with mentioning abuse. Otherwise she won’t get her citizenship.

Her attorney didn’t let her divorce. And telling her that she will have an issues.

So now she don’t know what to do.

He is charging her $2000Β for divorce through abuse +$3000 in addition and $500/ hrΒ Β in that case if her husband won’t sign the divorce through abuse (and she said he won’t because recordΒ Β will stay in his background)

So basically her attorney pushing her to fileΒ divorce through abuse.

Β

Any advice?

@sandranjΒ maybe you can give her advice?

Can she file agreed divorce and have her citizenship filed with no problems?Β
Or her attorney is right?

Thank you very much!

Her attorney has no clue about Immigration Law,of course she can get the green card or apply for citizenship if her divorce is not based on abuse.Tell her to find a new lawyer.

Well INA actually uses the term "departs", but that's one of those fuzzy legal terms. Like for instance BIA in Matter of Arrabally (2012) ruled that travel on AP is not a "departure" for purposes of a 10 year bar since AP is a defacto permission to briefly travel abroad so it makes no sense for USCIS to grant you it and then turn around and bar you.

The problem of course is that USCIS hasn't extended the ruling to include traveling while in removal proceedings or subject to a removal order, and BIA hasn't touched the topic since either.

Β

That being said, unless you want to try to become the namesake of a landmark decision, don't do it.

I want to understand why you quoted my answered because basically Β I answeredΒ Β what you posted above, and I am not the one who asked the question,I answered the question.

Good morning, Everyone:

Β

As a quick update, I contacted my congressperson last week. Waiting now on a response from her office.Β

Β

I am wondering if anyone haveΒ been able to get updates from your cases that is not through your attorneys? EverΒ since my VAWA filling, all my cases even travel and work permits are shield with the VAWA silence drama.Β USCIS would only communicate with her - not me. This happens via telephone and via letters.

Β

Thank you all!

Β

Β

The Β privacy Law Β prohibits the disclosure of your petitionΒ Β with you over the phone.Once you have an attorney representing you then they will answer your attorney inquiries.

My attorney told me that the reason for divorce does not matter. In addition, this lawyer charges way too much. I paid 800 usd for mine in NY

Hi everyone! Thanks for your support to my last message. My birthday was good, I didn't think much about my problems and just relaxed. It's so important to have a reset.Β

Β

As per VAWA, I haven't filed yet but once I do, I was wondering what are the common problems, stresses, issues people are facing? I read a lot of people have problems with EAD. I filed for my C09 extension for now. Once I file VAWA, can I get C31 EAD?Β

Β

I just wanted to file i360 and forget about this nightmare for quite some time... But it seems like it doesn't justΒ go away. Any experiences and advice to share?Β

Β

ThanksΒ

@Stillwinning!!!😊 and others,

I opened up the service request for my Ap which is pending over a year now on July 10th.

Β

Since the July 21st it saysΒ

"your inquiry about why your case is taking longer than our processing time, referral number SR119........Β was assigned to an officer for response"

Β

Since then nothing happened. I know in the past my service request was completed within a same day. This one is assigned to an officer for 3 days now. There is no other update.Β

Β

Any idea about it?Β

@Stillwinning!!!😊

The above my original post. Today when i logged into USCIS account. It says "On July 28, 2020, your inquiry about why your case is taking longer than our processing time, referral number SR11922002704MSC, was assigned to an officer for response".Β

Before it was July 21st now July 28.

Β

I think they are playing with my emotions.Β  The AP is pending since July 10th 2019.Β

yes you will get C31 once your VAWA will approve. The common stress that most of us are feeling is Wait time. For some it is taking really long time. Other than that you should be ok as long you haveΒ all the supporting documents.Β
