Timeline

Today I received the following response from the inquiry that my congresswoman sent to my Local Field Office. 

 

"Please be advised that USCIS records indicate that the application in question requires an interview.  Due to the uncertainty of the current COVID-19 situation, we are unable to provide you with a precise appointment date and time. Once a date becomes available, you will be scheduled and notified accordingly."

Wow! This just about confirms that NOT all cases will be approved without an interview as we've hoped for! But the pattern I've noticed is that the people who filed i485 after being approved for VAWA (i360) are the ones getting the approvals without interview! Just an observation. They need to really do something as backlog and wait times are about to go crazy!💁

It's not unusual at all...did you read previous threads? Some people wait for more than 24 months...hey I'm not saying it should be accepted..but for you to know you're not alone! Yeah you can seek assistance from your representative, they'll enquire about the delay..hopefully it moves things forward!😊👍

Hello VJ , 


My spouse filed I-130 I-485 I-765 I-131 on March 2019

Got my ead and uscis set the interview for January 2020

I filed for vawa on January 2020

On February 2020 they denied my I-130 because I missed my interview

On March I filed for ead renewal under c09

got prima facie on may 2020

june 2020 they sent my new ead

 

i saw on the uscis website that when you have a pending I-130 and fill a I-360 the I-360 takes the I-130 priority date 

being that my ead was renewed it means that my I-485 is still pending 

Does it also mean that my I-360 took the priority date of my I-130 ?

if yes does it mean that I’ll have an answer together with the vawas filed in march 2019 ?

did you go to interview? 

What is the status for your i-485 in uscis website?

If they renew your EAD c09 category that means your i-485 still pending. 

If your spouse was USCIS then priority date not gonna make any difference. you will have your i-485 interview once your VAWA get approved they will schedule am interview depending on your field office.

my lawyer told me to not go to the interview 


my I-485 says:

On November 29, 2019, we scheduled an interview for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number . We will mail you an interview notice. 

 

my spouse is a us citizen 

 

I know that my interview will be scheduled on my local office priority but I’m talking about the priority on my 360 did it took the I-130 priority ?

Yes, generally I-360 does take the priority date of previously filed I-130. This is seldom relevant since IR-1 and VAWA applications of spouses of abusive USCs are exempt from numerical limitations, meaning that a visa number is always available. This is generally only relevant in cases of VAWA cases filed by spouses of abusive LPRs which are subject to the same quota as the F2A category.

Contradictions without citations only make you look dumb.

@Demise I don’t understand why on the Question above uscis says USC or LPR , from your answer it only benefits LPR spouses .

I thought that they would take in consideration the time that I’ve been waiting and accelerate the vawa process.. 

Depending on a 1 year valid document (ead) it’s so frustrating  can’t wait to be over with this.

Hello everyone!! 
 

hope everyone is safe and healthy. Congratulations to everyone, approvals, EADs, taking the first step to end the abuse... everyone!! 
 

A little update from my end regarding C9 EAD + advance parole. 
 

my EAD was due to expire 3/2020. 
 

October 2019: EAD renewal and advance parole application sent to NBC ( yes, I know but my lawyer showed me his reasoning and I could not argue his point by saying my “internet friends say differently”) 

 

MARCH 2020 : fingerprints were applied to advance parole application 

 

Once it was out of processing time late MAY/JUNE 2020, I asked my local congressman to inquire and started an inquiry from my end as well. 


JUNE 30: EAD and advance parole approved

 

JULY 22: card delivered at my lawyer’s office

 

now, the card was mailed, card produced etc all were under the EAD receipt, I am assuming it will be a combo card but will update you all Friday once I pick it up. Even if it’s not, 🤷🏻‍♀️ No one is traveling at the moment anyway so whatever. 
 

I have not received any approval notice, but I think that was sent to attorney as well. 

 

so this brings me to the backlog of card production. I am extremely lucky to get it so quickly 🙏🏼
It may have to do something with me informing my congressman that I am a RN working during pandemic 🤷🏻‍♀️ Although I don’t think USCIS as a whole really cares or perhaps the officer liked my congressman or was in a good mood 🤷🏻‍♀️ Or the 🌙 Moon was in a good phase 😂

Hello @dreamer1 Congratulations on your renewal. Could you please confirm if you paid the Ad fees along side the renewal fee?

I had my EAD approved yesterday, which was filed in MAY. My VAWA has been approved, so I’m just waiting for an interview. I’m very grateful that my journey has been pretty seamless, since I joined this forum. I figured out how to do things on my own without listening to my attorney’s nonsense at times. She too told me to send my first EAD to NBC, but I sent it to Vermont. I’ve proven her wrong since then.
