Last week I just submitted my RFE for the I360, the good moral character and police clearance.

 

What does this mean when they said card being produced on that I765 c31 category I mistakenly filed?

 

Please help me! Does that mean I am approved? 🤞🤞🤞

I have been a silent reader for about 2 months. I was in another group did not know that there was a vawa group let me tell you my journey started in 2008 I was married to a USC and not until I got to the interview I found out from the immigration officer the my husband was a registered sex offender. I had a 5 year old at the time so I immediately kicked him out. I went to a lawyer in Brooklyn NY took my money did not help me. I was recommending in 2014 to a paralegal in queens he told me about vawa but because did not know what he was doing and also took my money, he wanted me to go to a precinct to get a restraining order and say he physically abused me I said am not doing that because its not true am not gonna lie on someone for a GC. Because we did not have enough evidence they denied me, even though he had that felony he never did anything to me.

I left it alone for 4 years in 2018 I was told about another guy in Brooklyn I went to him he put it back in I got back my work permit a year later right before I went back to renew my work permit I had a friend he went to him to get her daca for her daughter renewed and when she got the receipt from uscis it said vawa on the receipt I said something not right I did not go back to him a month he was arrested I give up again I received a rfe from uscis December 2019 and I said am scared if I dont reply they will deport me I went online and look for a real attorney in Manhattan I went to her not expecting anything because I was told from a lot of real attorneys nothing could be done for me. But God I went to her  January 9th 2020 explained everything to her she said to me you have a case i had cases that had less than you and won she said if you wanna go through it with it come by the 30th of January so we could start working on it. I got a psychologist and letters from friends but I was scared they would deny because they did in the past I had lost all hope thank God and since I joined this group I would read everyday @Stillwinning!!!😊 you give me hope I must thank you! You would say patience my dear and i felt it was me you were talking to.

When in 2018 did you applied for this vawa that was approved? It’s will help others waiting since 2018. We heard someone approved recently. He applied in January 2018. Thanks and waiting for your response.

Most likely they corrected your c31 by changing it to c09 either as a courtesy or because you sent a corrected form and will be mailing you a c09 card (even though you asked for c31 with that receipt number). hope that makes sense.  

Yes it makes sense. The only thing that's a little bit confusing for me also is that the receipt number for the corrected C09 i765 they sent me an rfe for 2X2 photos because I missed to provide that. So this is the status:

 

** I765 c31 mistakenly filed for renewal - card produced 

 

**I765 c09 corrected after I realized the mistake - RFE required for 2x2 photos.

Uscis received date was April 30th 2018.

Hello everyone:

 

Has anybody had a pending i-485 that stayed on hold while waiting on the Vawa approval? How did it get unstuck from the limbo? --I-485 filed on March 2017

 

I did biometrics, medical , RFE, and even interview where officer said he needed to wait for the Vawa. This was in Kendall, Florida. Vawa approval was Nov 2019. Then "Interview was cancelled" earlier this year. We filed "Case outside of processing times" and got this:

How longer will I have to wait now for NBC? Any clues? ----I feel so frustrated I can not tell you enough. This whole WAITING process has affected me emotionally big time. My anxiety has just gotten worse and worse. I am unable to focus at work. My attorney just increases my anxiety by just doing nothing unless I harass her. Please someone with a word of light will just do a lot to me right now. Thank you.

Sweetheart come get this hug! We all need it sometimes!😘😊 it will be ok..I'm not just saying it..It's because I know it! Have you read testimonies here? If yes, you'll find that things can change very quickly..at any time! We can give you different estimates..but things will happen when they will! This journey taught me patience..and trust me..it pays! Your happy day is approaching fast! I'll keep you in my prayers dear!🙏💖💖

Well you are going to have to wait to see what the card you get in the mail from the c31 petition says, but again it seems they changed it from c31 to c09 and approved it as c09 and that is what is being mailed to you. There is no policy that states they must change the category when you make a mistake like you did but their is also no policy that prevents them from changing it. So as I explained before if they did change it- it was either done as a courtesy by the Officer processing it because they saw you made a mistake when processing it and had nothing to do with you filing a correction- or a direct result of you filing a corrected form. Either way the corrected c09 petition you sent in has to be processed. They cant just ignore it or throw it out. So it got assigned a case number. It also got an RFE. If you responded to the RFE thats fine- when they get back to processing it they will see you already have a c09 and will deny your second filing of it. If you havent responded then you can either respond with the photos they want and as before they will ultimately deny it since you already have a c09 EAD -or you can not respond and it will be closed due to non response- or- you can respond and tell them you got the c09 and want to cancel the second petition/have them close it out. They will handle it in their system whatever way they need to. Its not really your concern. You can continue to track the case number just to see what happens to it but you should not get two c09 EADS. 

 

Now when your 360 is approved you will get the notification of card being produced on the 360 case number. You may also get a c31 EAD. Thats ok. If you do get the c31 EAD (which many people do because the system seems to send it out even if you have a c09 one) then you can send it back to VSC or keep it. You just want to make sure you renew whichever one you are using when its time. The c09 does not require a filing fee to renew if you paid for the 485. If you used a fee waiver for the 485+765 then you can send another fee waiver for the renewal if you still qualify for it. The c31 renewal needs a fee or fee waiver. Hopefully your 360 gets approved and you get the GC before your c09 EAD expires one year from now. 

 

Please let us know when you get the card in the mail which category it is.

Usually a case status of interview was cancelled means there was a date set and they cancelled it. Was there ever a date set? But honestly your best option is to contact your congressperson to inquire for you. Use google to find out who your representatives are. You have 2 senators and 1 house of representative. You only need to ask one for help. They should have a website with info on how to contact them for immigration assistance. You most likely will have to fill out a waiver so they can contact USCIS on your behalf. You may have to go to their local office but due to the pandemic a lot of things are being done remotely. But the first step is finding their info through google and reaching out to them via phone or email.

Thank you for your reply. This is a good question ----I never saw a "your case is ready for interview" status. I think it changed from "Your interview was conducted and your case needs review" to "Interview cancelled" status. I does not make sense. 

I have located the congressperson website. Thank you for the suggestion. I will wait for the notice to arrive before contacting her.

Hi All !
Hope you all are doing well and staying safe.
I am waiting for my i-485 interview.
VAWA and i-485 filed together in december 2017,
Vawa approved December 2019(By God's grace ).

This forum has been really helpful.@stillwinning and @sandraj are a great blessing to this forum.

Recently i have been reading of i-485 approvals without interview but couldn't keep a track.

Can you guys reply to this post
whoever got it without interviews so we can keep the count please .
