USCIS does not give ANY information over the phone in VAWA  cases, and AOS related to a VAWA case.

Thank you @sandranj for your reply. Here's an update:

 

03/2017   I-130,I-131,I-765,I-485 filed with Chicago Office

08/2017   divorce filed

01/2018   I-360 filed with Vermont Center

05/2019   I-485 interview taken in Kendall FL Office, case placed on "needs review" (officer said he needed to wait for Vawa approval first)

11/2019   I-360 approved by Vermont Center

05/2020   I-485 interview cancelled (not sure why, possibly due to Covid)

***07/2020 Attorney filed case outside of normal times

***07/2020 Case status changed to: "We sent you a duplicate notice about a decision on your form i-485 or describing how we will process the case if it is still pending. Your case is in our National Benefits Center".

 

Questions:

 

1. How did my case end up in National Benefit Center and why?

2. How do I check i-485 processing times for "National Benefits Center"? - it is not in the drop down list on USCIS processing times.

3. Now what is my priority date?

I received my C31 on April 30 and its been almost 3 months.. :(

 

I got my C31 first week of April and I just received my approval notice 11 days ago so you’ll get yours soon

That is for the i360 it came at the same time with the notice of the i765 c31 category. The i765 that said card is produced is under c31 though not under the c09.

you dont have the card yet so you dont know that it was produced c31, you are assuming it will be since thats how you mistakenly applied for it. Most likely they corrected your c31 by changing it to c09 either as a courtesy or because you sent a corrected form and will be mailing you a c09 card (even though you asked for c31 with that receipt number). hope that makes sense.

Challenge the territorial jurisdiction of the court... a great opportunity for you to avail if court agrees to.

He is able to file there for an annulment since we got married there based on research. Oh well...searching for Nevada attorney. Thanks much though hon.
