Sure you can send a letter to Vermont as you can request prima facie! It's not unusual that you haven't received PF..so many folks didn't get it and others got it later. If you will be needing the benefits it allows then go ahead..PF doesn't mean the petition will be approved.😊👍

11/2019   I-360 approved by Vermont Center

05/2020   I-485 interview cancelled (not sure why, possibly due to Covid)

 

Questions:

1. Who has jurisdiction over my pending I-485 case?

 

When I check I-485 processing times in Vermont, the returned results are just for visas T and U. So, not sure if I should look at Vermont, Kendall, or any other office. I have not receive notices of my case being transferred, not even from Vermont to Kendall. 

 

2. What priority date am I looking at for my I-485 case?

 

My I-360 approval notice says "priority date 03/2017". I have read some of you saying that the I-485 timeline starts when Vawa is filed, other say when approved, and other even mentions it starts when the case is "transferred to my local office". 

 

A side note is that all my calls to USCIS are unsuccessful. They want me to send Vermont a letter. My letter gets denied because "they can not provide information of my case to me, only to my attorney". My attorney is not always responsive to my requests. 

 

For reference, the current I-485 processing times in Kendall says Jan/2018. Vermont approval based on T visas Sept/2018 and U visas May/2018.

1-Your local office.

2-USCIS write in all notices about the priority date , but just a green card holder's spouse has a priority date. If your spouse is a green card holder then the priority date is the day the VAWA petition was filed.

 

USCIS does not give ANY information over the phone in VAWA  cases, and AOS related to a VAWA case.

So I contacted my congressman like a week ago and they  send me this regarding the response of immigration. 😟😕

 

“Here is the response I received from USCIS:

 

Hello ******

Name: *******  

Receipt Number: ********

Form: I-485

Thank you for your inquiry regarding this constituent’s immigration matter. This case is awaiting biometrics submittal, and is currently in suspense until the applicant completes this process. The applicant has been placed in the biometrics scheduling queue. When the ASCs (Application Support Centers) reopen and scheduling resumes, cases will begin getting scheduled in the order they were received, taking up where they left off in March. Once biometrics are received, this case will resume normal processing. Please see https://egov.uscis.gov/office-locator/#/asc for more information. 

We hope the information provided is helpful. If we may be of assistance in the future, please let us know.

If there is anything else our office can do please feel free to contact us.”

My vawa was approved december 11, 2019and transferred to the nbc november 13, 2019, ead c31 card production on november 15, I know it’s odd and done backwards but thats the timeline and my courtesy letter was sent to me on January 26. 😕

thank you for answering me. I saw on the DHS website that American citizens and their immediate family could still travel to Brazil and come back. 
It’s very confusing..

I applied in August 2019 and never received prima facie as well till now

Thank you so much for your kind words🙏🏼  @Stillwinning!!!😊 😭😫 is just hard to believe that everything is slower after this covid-19. I also didnt imagine I needed my biometrics done. Hopefully I get a letter with my biometrics letter soon , at this point I dont know when that will be 😕

You need to understand what I posted before.The U.S'spouse is exempt from the ban because who travelled abroad  will return to the U.S to join the spouse here(family unit), it's not her case, she will not join her husband here, she has a VAWA pending.

 

Can she travel? absolutely!. Will she reenter? probably not.She might reenter if the officer does not pay attention that she is a VAWA petitioner.If she was my client I would advise her not to travel.
