My initial questions are:

 

1) Once my C09 EAD extension expires in May 2021, do I file for another C09 extension while VAWA c31 is pending? As I understand VAWA EAD takes 2 years to come along. I am afraid to have gaps in my employment as I missed a lot already.

2) I haven't really been in face to face contact with him for several months, can I still file VAWA?

3) I do not have police reports, is it bad?

4) He is extremely powerful and wealthy so I am afraid about the ways he can screw me over.

5) How many pages does my statement have to be?

6) Does anyone have an example of successfully written story/filed case?

1-In your case as long your AOS is pending your work permit is good, and submit form I-765(CATEGORY C9)to  renew 6 months before expires.

2-yes you still can file VAWA.

3-IT'S not bad but you will need to attend therapy and submit a psychological evaluation.

4-USCIS does't care if he is wealthy or not.

5-I suggest at least 7/9 pages.

6-If you were abused you  have your own story.Each story of abuse is different, are you sure you have one?

VAWA is an entirely different petition that will be adjudicated separately..the approval of the C9 i765 has no influence on the i360. If the officer is satisfied, you'll definitely be approved!😊👍 Have no fear..I'm sure you will be approved!😀

I see, I know people are still waiting who have filed in 2018, I hope everyone’s gets approved soon.

always remember opinions are just that- opinions and every case is different- what worked for one May not work for you. 
 

I think it's clear now to me especially the content of your text! I went through previous threads as thoroughly as I could when I first joined this amazing platform, and I can say with confidence that there are too many inconsistent 'truths' shifting meanings to gulp down any information without first investigating it regardless of who put it out there! Knowledge is power and when you equip yourself, you won't have to tow the line of sycophancy. Power to the people!🙌🌟 Enough said!

Thanks Sandra. I do have my story and I did attend therapy while I was abused (only 5 times though as it was included through my employer). I am still suffering every day and can't live a normal life whatsoever. I am trying to get over the abuse but writing of the case brings me back to that horrible state. I don't sleep at night and my work suffers. The reason why I wanted to see a successful story is because I do not know the format, nuances of filing etc. as I don't have a lawyer.

USCIS issues RFE for many reasons such as, asking a new medical exam, asking proof of a bonafide marriage, asking a copy of birth certificate etc...and it doesn't mean the person after answering the RFE might get  the  GC without interview.

Hello everyone! I am glad I found this forum and after seeing so many helpful contributions, here is a timeline in case it helps others for reference purposes. I also have a few questions. Thanks in advance!

 

03/2017   I-130,I-131,I-765,I-485 filed with Chicago Office

08/2017   divorce filed

01/2018   I-360 filed with Vermont Center

05/2019   I-485 interview taken in Kendall FL Office, case placed on "needs review" (officer said he needed to wait for Vawa approval first)

11/2019   I-360 approved by Vermont Center

05/2020   I-485 interview cancelled (not sure why, possibly due to Covid)

 

Questions:

1. Who has jurisdiction over my pending I-485 case?

 

When I check I-485 processing times in Vermont, the returned results are just for visas T and U. So, not sure if I should look at Vermont, Kendall, or any other office. I have not receive notices of my case being transferred, not even from Vermont to Kendall. 

 

2. What priority date am I looking at for my I-485 case?

 

My I-360 approval notice says "priority date 03/2017". I have read some of you saying that the I-485 timeline starts when Vawa is filed, other say when approved, and other even mentions it starts when the case is "transferred to my local office". 

 

A side note is that all my calls to USCIS are unsuccessful. They want me to send Vermont a letter. My letter gets denied because "they can not provide information of my case to me, only to my attorney". My attorney is not always responsive to my requests. 

 

For reference, the current I-485 processing times in Kendall says Jan/2018. Vermont approval based on T visas Sept/2018 and U visas May/2018.

The USCIS Office in the city where you live has jurisdiction over your I-485.  You have to search for your city and see their processing times.  Your timeline dos not start until case file is at local office after it is processed at NBC.  

 

All I-485 will have the priority date of when you initially filed it.  

Phase I - IV - Completed the Immigration Journey

Hi All,

 

I´ve been reading all the post and now i´m woried about something.

 

- 11/15/2019 - Uscis received my vawa application on .

- 12/15/2019 - they asked me for proofs regarding good moral charater 

- 12/31/2019 - they received the documents.

 

Until now I haven´t received any prima facie. Is this normal?. should I get worry about this?. should I send a letter to vermont? I'm not planning to request benefits but I don´t know if should I ask it to vermont.
