Hi,

For permanent residents that obtained their greencard through marriage, there's a general 5 year ban to sponsor a new spouse.

I filed for my husband 3 years after receiving my greencard through vawa - almost 5 years after I left my abuser.

I married my husband 2.5 years after the divorce from the abuser was finalized in court.

I received an RFE for the I-130 which scrutinized my vawa (I had to provide proof of bonafide marriage to the abuser all over again), as well as the new marriage.

It was a lot of work, but we eventually received approval of the petition. At that time, my citizenship application was already pending.

@AhmedEid hello dear, prima facie is a very good sign, it means USCIS found you qualified candidate for Vawa Approval,.. if you get prima facie determination you should rejoice,  in my own opinion, it mean 75 to 80 percent of your Application has been approved, USCIS may request more documents or may not most times police clearance from home country or birth certificate, this doesn't mean the case can not be denied but it very rear cases and not common.. only if they request something and u couldn’t provide it and your explanation of why you couldn’t provide it wasn’t clear enough... stay blessed.. Hello Family, I hope everything is going well with everyone and InShaAllah their approval will be coming shortly.

I finally saw this update on my ead application that I applied on Nov 2019 on vawa basis. 
 

then I check it again few days later it says, the ead has been approved.

 

what’s next and what does this mean for Vawa?

Response will be much appreciated and ease a little anxiety.

Good morning, please how long does it take for the C31 card to be sent after new card been produced. I got the update last Tuesday. And also, how long does it take to finalize the I 485.i am in orlando, Fl. What is the next step.Thank you.

Hi..congratulations first of all..I celebrate all approvals! So is this the C9 or C31? I'm assuming I765 C9 category right?

Hi..After new card produced update, you'll also get the card mailed update..then you'll receive it in a few days..also depending on your field office the i485 can take as little as 4months to as long as 17months to be processed. In NYC, it is even longer! The pandemic isn't helping either..people have been waiting..even though few cases are getting approved without interview which like I said is based on the discretion of the adjudicating officer! It's great to be approved without interview! Matter of fact that's what I want for everyone waiting but I just wanted everyone to know that USCIS hasn't published anything to that effect..which is why it is solely based on the discretion of the officer..this implies that not everyone will skip the interview!💁

If you have a strong VAWA case then you can for adjustment of status now , but if your attorney has  any doubt that your case might not be approved then wait for he approval, because if your Vawa is denied you will be removed from the U.S.

Overstaying or entering through Mexico is not a problem for Vawa petitioners.

The White House imposed  coronavirus travel ban on Brazil.The U.S Citizen's  spouses are exempt from the ban because they will reenter to stay with their spouses, and it's not your case because you won't reenter to be  with your husband.
