@Pinkrlion yes that been going on mostly for people that filed i360 and i485 together... if you check immigration  lawyers  videos on YouTube  you would see they are saying same thing cos their clients are getting green cards without interview mostly Vawa cases...and few marriage base cases....

 for those that has pending i485 with previous spouse before filling Vawa I haven’t heard anything concerning those  i485 cases but I pray we start hearing good news from that angle soon...

@Cupsy I'm getting a little confused here...has your i485 been approved? If I understood your post correctly you were asked to provide your birth certificate..a lot of people here were asked the same RFE and are currently awaiting interview! It is true that some folks were approved without interview but please be informed that it is only at the discretion of the adjudicating officer..so you don't get left high and dry! #just saying!💁

Prima facie simply means 'based on first impression' taken as correct until proven otherwise! It does not guaranty approval..it definitely gives you access to a number of benefits while your case is adjudicated. If the officer is not satisfied at the end..your case can be denied!

After USCIS receives your I-360 petition, it will send a receipt notice to the address you have provided on the form. USCIS may then review the self-petition to see whether it can be approved if everything you stated within is true. This is called a “prima facie determination.”

If USCIS decides that your self-petition can be approved if it is true, it will send you a “Prima Facie Approval” letter. This does not mean you are granted anything yet. It does, however, mean that you can qualify for some types of public assistance. After sending you this Prima Facie Approval letter, USCIS will take more time to look carefully at your self-petition.

If USCIS needs more evidence to determine whether it should approve your I-360, it will send you a letter asking for it. You will have 60 or more days to give USCIS the new evidence or an explanation as to why you cannot do so.

If USCIS does not believe you qualify as an abused spouse, parent, or child, it may send you a “Notice of Intent to Deny.” This will state the reasons why USCIS believes you do not qualify, and it will give you additional time to send evidence that will change its mind. If you do not do so, USCIS will deny the self-petition. USCIS can also deny your I-360 without sending you a Notice of Intent to Deny.

Dear all newcomers to the forum, 

 

WELCOME TO THE FAMILY 🤗 

 

Now my dears, we are all here for each other and I absolutely adore and appreciate this support network. 
 

I WOULD HIGHLY RECOMMEND: 

READ through previous threads... At least last 10 it REALLY helps!! In several ways

1. You get to know the overall general VAWA process

2. Most common hiccups and solutions to them. 

3. you get to see what works for most people and how there are exceptions to the ‘trend’- this way when something unusual happens with your case, you don’t freak out. 
 

When in doubt, go to USCIS sources, you have to do some digging but will find the answer there or some documents released by them.

I am an advocate for reading previous threads and using other research resources..it helps greatly to counter misrepresentations and misleading information to a large extent while supplying you with firsthand information. You can not go wrong with this! During my case..I worked harder than my paid attorney..we can't afford to relax in times like this..we should endeavor to constantly seek information regarding this petition! Welcome again new members!🙌👍

Exactly! 
I have said so many times here and I repeat myself, educate yourself!!! Do not believe anyone just because... including your lawyer, or anyone in this forum. Listen to what they have to say and if they give you their reasoning/explain why xyz... is the way it is. 
 

always remember opinions are just that- opinions and every case is different- what worked for one May not work for you. 
 

And these trends that come up, latest one being people getting their green card without an interview- it’s not a rule or a policy. It’s just something that is happening right now due to this unique public health situation. 
 

I mean yea, everyone wants their stuff happily resolved like yesterday, including me... but no one is entitled to it/ any immigration benefit, it’s a lot of work and burden is on us as we want to be part of this land and be able to be called Americans as legally as we are in spirit and heart 🤗🇺🇸

@Cupsy my dear due to coronavirus some cases are getting quick Approval than some .. 

As I said in one of the Reply to you, I said I have noticed that people that filed i485 and i360 together has been getting interview waved , we have abt 2 to 3 cases here on VJ so far like that , and also a couple of them on face book and all that have seen are people that filed i485 and i360 together like you.. so am praying for your own to be like that also... I never said all Vawa cases never said that pls read my previous response to you dear.. , I have not seen pending i485 cases filed by previous spouse that are pending , getting this interview wavers yet... here a link of video u may benefit from 

  I never said it’s every Vawa case ... becomes some people are trying to twist my words on here for no reason...
