Hello to you all, I have a question. My I-360 was approved on july, 2019 and Approval letter sent dated September 2019. I haven't heard from USCIS since (10 months). How long do you think it takes to send my I-485 to a local office? or do VSC process I-485? Thanks

One way you can find out is if you sent a service request on the uscis website, if your i-485 is in the local office or the nbc whenever they respond to you via email or mail it will said your local office city or the nbc. I tried that for simply curiosity once and saw that my local office address was addressed on their response about my service request via mail. I saw somebody advice about this on an immigration website and thats how I know, it does work lol 🤗

I hope I understood your enquiry well enough...but here are important things to note!

1) You are eligible for citizenship after 3yrs of being a permanent resident( Greencard holder) If you were married to a U.S. citizen!

2)You can start the naturalization process from 2yrs and 9months of being a permanent resident.

3)Your tax documents from the past 3yrs is important as it's part of the required documentation for the process!👍

Thank you so much! i think i made a mistake in my 2019 return and put parents which i support as dependents and made myself a head of household. just found that they are not eligible as not living in the us, canada or mexico. will amending the filing / or calling them to disregard the filling if at all allowed  will fix it in the irs records or irs will come back with an audit (i still did not get my return due to covid yet)? cpa was not accurate and did not provide me with right info. my parents are quite old and i was supporting them but irs seems does not allow it for tax purposes.

My last question - if one had unlawful overstay of few months (3-6) will that disqualify from i-485 through vawa? reason asking is that a note "visa overstay" was put in the i-485 application but i entered the usa all legally on h1b visa. basically a unlawful gap between my ex-wife withdrawing i-130 and my filing for vawa was less than 2 months (this seems to be the overstay)

Question about the Covid travel ban.

I have a pending I-360 and pending I-485.
I have a travel planned to Brazil in October.

I’m still legally married to my USC husband. My daughter who is also a US citizen will be traveling with me.
Any chance we would face trouble coming back of should it be ok since I’m still a USC relative? I have a valid advance parole until 12/2020.
All feedback is welcome.

thanks in advance!

Actually that's a long time..whoa! You really should contact your representative..the current situation may have contributed to the delay obviously..they probably will end up approving you without interview..I sincerely pray for that!🙏🙏🙏 it's about time!

@Stillwinning, I appreciate your kind words !

Hi, maybe you should contact your congressman or senator to assist with that, if you haven’t done so yet,  because the normal processing time on Uscis website for Brooklyn NY is from 8/5 to 30 months, but you are still in the normal processing time. I feel your pain.

“Thank you  so much !

One thing I won't do is tell you what I don't know! Please discuss with your tax preparer about that! Also most of us overstayed as well I don't think it's gonna be any trouble!👍

Long as you have a valid AP you should be good..just check about the travel restrictions regarding  the pandemic to the your destination and back to the U.S. end..most flights and travel in general are back in business!👍

I am not sure, I never received the notice that my file was transferred.  I only received courtesy letter for medical.  Maybe someone else in your city can answer.

Friends - would anyone know if VAWA is considered to be "married to US citizen" and waiting period for naturalization is 3 years? Also, learnt that naturalization requires 3 years of past tax returns if "married to US citizen" green card is held. Would you advise please if this is correct and how much scrutiny is given to past tax returns.

I don't believe they are picky picky over tax returns.  Submit tax transcripts for the past three years.  They want to see if you are being a responsible and filing your income taxes as required.

thank you as having a similar situation- thing is my cpa might have been not ethical as what I heard lately from others. This link made me worried especially for me as if I made a mistake it was not intentional at all

I am not sure, as Brazil is a country in the travel ban for the US.  You do not want to get stuck in Brazil and your AP expires.  I would re-apply for AP before you leave, so you will have that receipt with you.
