About my i-485.There has been no status update it still says fees waived on December 1st 2017,nothing has changed.im really stressing at this point,but trying not to worry because faith and worry does not go together.

 

December 2017 is quite a long time...not that there aren't other people waiting from earlier months in 2017...just that I do understand how you must feel especially as more recent cases are been adjudicated! Anyway you have to contact your congressman so they bring you some form of closure by enquiring on your behalf! This sometimes sets things loose..and rolling..certainly not in all cases as security checks can pose a significant delay in the process..but it's best you know exactly what you're up against! @Comforter You asked what the next steps are...if the interview is going to be waived.. Anyway there is nothing written to suggest that, it has always been at the discretion of the adjudicating officer! It's possible some cases will be approved without interview..so keep an open mind there. The standard sequence is for your i485 to be transferred to your local office where it joins a queue waiting for interview..before then, you may get a courtesy letter requesting you update your medicals..obviously not everyone gets them. When a date becomes available for you to attend your interview, you will be sent a notice informing you to attend your interview on the scheduled date! I pray more people get their Greencards sans interview.🙏 Saves time, money and energy!💁😀👍

Spouses of green card holders don't have a priority date.

When USCIS decides to waive the  interview they won't take into consideration if the AOS was filed concurrently or not.

They do not want your medical other than at your interview unless they ask for them in your courtesy letter.  It will get lost, and you will have to do another one delaying your GC approval

I'm trying to do some research as what is the best path to take here.  Since everything is submitted, I'm waiting for my AoS. With the current global pandemic, who knows how long that could take.  I really need the ability to work, so I can get a job and work experience. But from my understanding with the VAWA, I may not have the ability to work because while everything is being processed. Or is this different, because I have already filed my papers.  The ability to travel is important to me, but right now it is the ability to support myself while the AoS goes through.   If I go the VAWA right, do I have to start over?

 

In the meantime, I'm trying to work on my marriage with my spouse. I'm going to therapy and I told him I'd like couples therapy, but truthfully I don't see things working out

 

I tried to talk to my lawyer about this, but they were not very helpful, and simply said "Wait until you get your receipt and then we can talk options"

You need to decide if you want to continue with the VAWA petition or to work on your marriage.VAWA Law was not enacted  to apply for a green card because the spouse doesn't want to apply for the adjustment of status.It doesn't make any sense  to work on your marriage if you are suffering abuse.

I am un able to see the receipt number since i can not view the image of the check front or back. I did not receive any receipt in the mail. Its going to be almost a month and a half. Have them ask about all your pending cases.

What is your field office? I would recommend you to contact your senator or congress person so they can inquire on your behalf. Its almost a year you should inquire

I received C31-based EAD February 2020, approval notice March 2020, then courtesy letter April 2020 (meaning April my case has already been processed by NBC). Then in June 2020 I inquired with my congressman on case status and USCIS responded that it's still pending in NBC? Why? No clue. But you can find our where yours is through congressman, takes about 2 weeks.

thank you so much for being so helpful. Wondering how did you go about contacting congressman..did you just call their office and provided necessary data? Did you do it after certain waiting point? I received my c31 ead in April and still not change to I-360 status but my filing/priority date is nov 2018 and uscis technically reviewing July 2018 filings now per their website. Also - what did courtesy letter say? I am in Houston too and wonder how your process went so quickly from ead 31 to nbc - very happy for you

Hmm ok, my attorney sent me this about the notice;

 

"They just sent the notice to advise you the medical exam needs to be submitted on the day of the interview or if they request it."

 

I guess I'll avoid sending my medical exam then, thank you for the help 👍👍

Yes, definitely ask about both. Follow-up in 2-3 weeks with congressman if you don't hear back.

Your countdown for an interview wait starts once your I485 is transferred to local office (usually ~4 months after I360 approval). There are people here waiting almost 2 years since I360 approval to get decision on I485, I guess nothing to be stressed about but also nothing you can do to speed it up. Medicals you don't need until you receive an interview notice.

Yes just call, ask for immigration representative, and they will explain what to do from there. If it was me I'd call in like a month or so, but nothing's stopping you from doing it now.

You are/were married to a citizen? If so then nothing else to worry about, since you got your C31 card. The letter may come within ~3 months of you receiving the card, but for some people it never does. Still rest assured your VAWA is already approved.

Courtesy letter said I will need to bring medicals to the interview, nothing special. Will probably be same for you, you're borderline on that 2-year mark. It's not going fast for me, approval was end of January, courtesy letter in April, and now 2 months lates my case is probably still not in the local office. No clue what the interview wait will be like, but I guess nobody does with these COVID changes.
