It is an option. You can try it. The worse that can happen is that, if they reject the waiver, they will send your application back and ask you to add their fee and send it back to them. I didn't bother to do that because I am currently working so I didn't have any way of proving financial hardship and therefore I didn't want any delays or back and forth turmoil with USCIS.

Hope you all  are doing ok.

 

So when i started my vawa journey my attorney told me they used the i485 for my marriage instead of filing a new one .

How will i know that they did accept it because i havent heard anything about it since then? Is there anyway i can check it?

Your attorney sounds like he or she knows for sure..you should ask how he or she is sure about it. Did they ask USCIS to hold it in abeyance pending when the case is adjudicated? Usually you get a transfer notice..movement from local office to VSC! Ask if any letter was received..get some assurance not just mere word of mouth. Another positive indication was that you didn't get a denial notice either! Also you can enquire through your representative\congressperson to know the status of the petition! It's a good resource that helped me out tremendously!😊👍

mine was the same. My lawyer and I went to the interview and asked the officer to hold mine and he did. did y'all go to the interview yet?

Thanks again for the reply.  We did send a letter saying that we cannot make to our marriage based interview and indicated that we filed for vawa. Neither me or the attorney received any notice that it was transferred to any office and we also did not received any denial letter.

We did not went to the interview thats why im nervous if its still valid.

No it doesn't complicate VAWA at all..it's even recommended for ease towards obtaining your Greencard. Well it's possible your i485 is being synched with your VAWA...but the smart way to be sure like I suggested earlier is to enquire through your congressperson! If this is the case, that is..if it's put on hold, then you do not need to file a fresh petition!😊👍

Hi, from what you said, you don't have to file another I-485 since you have sent a letter to USCIS that you file VAWA and as of now you have not received any denial notice, and like It was advised earlier,  if you have any doubt ask your Congressperson to inquire on your behalf.  Don't waste your money filling another I-485.

Dear Kersac so I have a question that have you already applied both c31 and  c09 along-with I-131 

Moreover if yes have you paid the fees of 410 altogether for both c09 and c31.

and you have revived the notice of action as well is these are 3 receipts Ie for c09

c31 and I-131.

MY Timeline in brief-
i-360 and i-485 filed in december 2017 
I-360 approved in december 2019 

The case status for i-485 shows "Name was updated " after the i-360 approval 
No update on my i-485 case since my vawa approval apart from Name has been updated .

I see people discussing about updates on file transfer to NBC or to local office.
This got me alarmed.Thats the reason i am posting here.
Any help or guidance or if someone can please share if they had similar experience as me would be highly appreciated.
because it's been more than 7 months since my approval.
