My partner has called me names, such as "little ", "little ".  He has smacked me upside the head when he was drunk.  He keeps threatening the relationship and how we should break up.  As well, he says "He has a long line of guys wanting to hook up with him." Hearing all of this is quite exhausting.  I know my story isn't as bad as some others, but for me, this is a lot to take on. 

 

I truly have a feeling my partner would follow through with the filing if I asked him, too.  He simply wants all of us to be happy in the long run.  I also have asked my SO to do couples counseling, and he said yes. So we will see what happens

I've filed I-485 on November 20,  2019 with medicals, hoping that it will speed up the process.

My VAWA was approved February 14, 2019 after 2 years of waiting. Before that my first I-485 was denied and I've never even had an interview in a first place.

That is a blessing, that I wish for all of you awaiting your VAWA approval and Green cards.

Let's hope we will see more approvals coming our way!

Do you mind sharing what state are you in? And also why did you wait 9 months after your approval of i-360 to file for the 485?

I am in Florida.

That is a good question:) My attorney made a mistake and assumed that my first I-485 was still pending with USCIS.

So when my VAWA was approved he basically didn't even check the  status for my green card application. He just assured me that it is pending and we need to wait.

While it was denied, the trick is that every time when I would go on the USCIS status check website and put my case number it would show that it was transferred to another office and other office now has the jurisdiction on my case. 

I've waited like this 8 months and grew suspicious. I've contacted a local congressman's office and  asked them to inquire on my behalf.

Shortly after I found out that my I-485 application was denied in 2017, right before I applied for VAWA.

If it wasn't for my attorneys negligence I've could applied for I-485 along with my VAWA application.

When I told him what happened he said that I need to pay $5000 more and we will apply for I-485. He acted like it wasn't even his mistake and cared less. Not to mention that I've already paid $5000 to that attorney which supposed to include I-485). That was just horrible. I was without a work permit and SSN single mom living like that for 3 years. It was really hard for me ... 😢

Eventually, I put myself together and applied without an attorney on my own 9 months later :)) and here I am. 

You know , getting my GC without an interview and being approved faster than I've thought. It's a great success, a compensation in a sense, for that time that I've missed and a proof that God Almighty really heard my prayers.

Wow that was a long process. Attorneys can be very difficult to work with sometimes. I'm glad your journey is over. Congrats again! 🥳🥳

C31 can only be issued when your 360 is approved. Your 360 is not approved correct? You say you applied Nov 2019. The 360 approval can take 1-2 years from when you file. So if you want the C31 EAD you will have to wait for 360 approval. It will be mailed automatically as there is a box on the 360 where you check off that you want the C31 EAD. Often they send the C31 even when you dont check the box.

 

C09 can be issued if you have a pending 485. Not all VAWA applicants have a pending 485 (if their spouse was not a USC). It seems your spouse was because you filed the 360+485 together. If you want a c09 EAD you have to apply for it. If you paid the fees for the 485 its free to file the c09 765. If you used a fee waiver then you need to do another fee waiver for the 765 or pay the fees (seems like you paid- so you would just submit the 765 with the 485 NOA). The c09 EAD can take anywhere from 3 months to 1 year. Processing times are always changing. It use to be 3 months or less, then there was a huge backlog and people were waiting up to a year. Its starting to even out again but you should still anticipate a 6 month wait from when you file. Overall you are most likely to get the c09 EAD before VAWA 360 approval (which would give you the c31 EAD with it). 

 

So if you have a pending 485- its better to get the c09 EAD while 360 is processing rather then wait for C31 after 360 approval. 

 

I know I am throwing a lot of information at you- please ask any questions if its not clear! :) 

 

You can file the c09 by yourself with out any problems. Its a very easy form. You dont need congresspersons help unless you are going to ask for an expedite. Personally I would tell the attny that they messed up- why would they have filed a c31 765 with your package?? First of all theres a box on the 360 for the c31 EAD, and secondly they should know the c31 wont be approved until after VAWA. They shouldve filed the 765 under C09. They filled out the wrong category on the 765 and should fix it with out charging you- Now you may not want to argue with them, and in that case you can file it yourself. But I would also re-check everything they sent for errors because it doesnt seem they are familiar with VAWA. 

Thank you for your honest and extensive answer that makes my mind even more clear. I would definitely file myself but if you have any suggestions on what to pay attention when filing the form I765 With C09 category please point on some tricky questions.

Hello Vawa family. I need your opinion and honest advice based on experience. I have filed I360+I765 C(31)+I485 in Nov’19. Does any of you Have heard that Uscis approved (issued any kind of Ead) before approving I360?
And If I file now aditional I765 with C(09) category will have negative impact on my case in general? 
also do you guys think it is a good idea to ask for help from Congress person?

I am a green card holder from VAWA ( Oct 2018 )

I applied for kids abroad to i-824 and they are approved and NVC documents qualified  visa category IB1  ( December 2019 )

 

Now they should have been waiting for interview at US embassy over 7 months

 

Do you think I can do anything to get their interview expedited ?  Congressman help ? Or this proclamation ban their interview.

 

If this is not the right form now. Please guide me the right form on VJ  to get a reply

You filed c31. It will come after vawa approval

 

yea you can file another i765 c09 based on pending i485
