Hello good people. Need your advice regarding EAD. My attorney has filed I485,I765 and I360(c31 category) all together. PD November 18-2019. Do you think I will receive EAD c09 anytime now (Its been 7 months) or It is better to ask my attorney to file case inquiry or maybe another I765 with C09 category while waiting for initial I 360 approval. My timeline is: PD: Nov18-2019

Biometrics Dec16-2019

Rfe for police clearance from home country Dec15-2019

Respond to Rfe Dec30-2019.

PF Feb 4-2020

thank you guys in advance for your answers. I have learned a lot reading this forum. There are a lot of Experienced people here. Happy that I found this forum.

He applies under category C31 because he doesn't know about  Immigration Law. It's unbelievable how these attorneys practice law.File under category C9 otherwise you might wait one year to have your case approved.

Hi guys, I had a police certificate requirement for K1 Visa, so I had it prior even entering the US and used that one for VAWA. Did you need one for when you was going to the Embassy ?

If the person will receive the immigrant visa abroad then the person will need a new police clearance.

Dear freinds

yesterday I was on job and there is a big gun robbery the police came after robbery I have a police report as well

Moreover later on I went to the hospital for check up since I have minor injuries

since I have no insurance the hospital authorities are asking to pay the bill via emergency Medicaid or via charity

so I have a question since my VAWA is approved will this be a public charge

Vawa petitioners are not subjected to the public charge.

I only submitted i 360 alone .i did not submit  i 485 and i 765.is this normal?

If your spouse is a U.S citizen you can file form I-485,but if you have a pending I-485 do not file a new one.

No, it was mailed to Chicago service center. That's what the USCIS website says to mail to if you are filing based on an approved VAWA. If you file concurrently with i-360 then you send it to Vermont.

You misunderstood what USCIS posted. USCIS mentioned  that "The beneficiary of an approved Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, based on the eligibility category “Battered Spouse/Children,” and you are filing for adjustment of status, should file with Vermont.

Can i get the travel document before the VAWA approval ?!

Yes you can get advance parole if your spouse is a U.S Citizen, and then you can file for AOS and file the form I-765 as well.

I think the only country you cannot visit is your home country while pending asylum otherwise you are free to travel any other country. Correct?

It's not advised to travel abroad with a pending asylum, despite the person can travel to other Countries. The person should not travel to his/her home Country tho.

@sandranj @Stillwinning!!!😊

Does anyone know what that means,

My i-131 is pending since july last year. I called USCIS and they said write a letter to Vermont, which i did and never heard anything.

I reached out to my congressman and i got the response that they sent the letter to NBC. I told them why they did not send the letter to Vermont, they said case is being adjudicated at the National benefit center.

I am not really sure what that means? does Vermont has my file or NBC? who will take a decision on my case Vermont or NBC?

It probably has been transferred to NBC. The petitions go to VSC and then VSC transfers accordingly. I believe your case is at NBC now. Vermont transferred your case to NBC. That's my understanding. You should be more concerned about the delay than where it is processed. Keep pressuring your rep so that at least you will have a favorable response as soon as possible!👍

Hi everyone, I had posted here before about the I485 RFE I got for my birth record. I’m about to mail a package to USCIS regarding this RFE and I wanted to double check with you guys...It’s ok if I send copy of the documents, right?

Obviously I can’t send them my original diploma or national Id card but I’m Wondering about the Documents that I got from the consulate.

I got a criminal record and birth certificate record from the consulate

I got another birth certificate record from my country and my parents mailed it to me.

I got my Diploma translated

I got my driving license from my country translated

I got my National ID card translated

thank you so much!!!!

Is best to sent specifically what they are requesting because thats all they needing from you. Yes you can sent Copy of your birth certificate, but if you can sent an original one is best since you mentioned you have several one from your parents and your home country consulate.

Basicially we are required to send in copies..and attend interview with originals..no big worries or stress about that..if you have multiple original docs..simply send it in! Good you've translated the necessary documents! Looks like you're all set! I'm waiting to hear good news in due time!😊👍
