 Do you have any idea why they are sending me a new card knowing that i havent even been approved yet?

At this point, with all the USCIS delays, possible furlough, and what have you, I wonder if it might be faster to do it via court.

It’s been almost two yrs since I file vawa and no response, not even RFE.  Well did you mean faster with court to get GC ?

Also Sandra will input and give her opinion from a legal angle..be rest assured you will be okay!

While in removal proceedings you basically have two options:

1. File I-485 with the court (have to reopen proceedings if you have a final order)

2. Terminate the proceedings and file I-485 with USCIS

 

If you file with the court the judge can adjudicate the I-485 and grant you AOS. If wait time to get a hearing in Immigration Court is shorter than wait time to get an interview with USCIS, you could in theory get your AOS done faster that way.

Hey guys , can someone tell me what I have done wrong I have created an account on USCIS to receive notification by email and text message...but never receive anything even when I file for renewal with Ead. ..please can you tell me what I have done wrong....Thanks ❤

I’m from Chicago , immigration court must be very busy .

For me it took about 3 months to terminate the hearing from the time we sent the motion to terminate. In my opinion, the only reason it was granted is becuase of Covid. 

The price will vary, I hired my attorney for the whole process. VAWA and our back up plan was to file for VAWA cancellation of removal with the court. All together I paid $16k. 

If you're only filing for termination of removal proceeding it should be much more cheaper.

If you're doing Vawa cancellation, that depends on immigration court and the back log. Obviously these days Immigration Court are wayyyy behind. It can take at least a year if not much longer. When is you next court hearing ?

Long and I wouldn't recommend it unless you're subject to a permanent bar of some sort that prevents ordinary AOS, for example the permanent bar for unlawful re-entry is not a bar for COR. Current wait times are about 4 years and you have to go to court every year to basically re-litigate your case until a visa number pops up, and it's not fun to air your dirty laundry in court, and standard of evidence is higher for COR than for AOS (for example COR requires you to prove that you or your child would suffer "extreme hardship" if you were removed). Non-LPR COR cases are limited only to 4000 grants per year unlike VAWA self-petitions which are either not subject to any quota (if abuser was a USC) or fall under F2A (if abuser was an LPR). The 4000 COR quota is shared with non-VAWA cases.

 

Like if you are on the verge of being deported do file a VAWA COR application with the court, also file I-360 with USCIS, it will probably be approved before a number for COR becomes available, then you can withdraw the COR and just do AOS instead.

For first part they want a divorce decree regarding the first marriage. For the second part they want an affidavit that he has a clean record and ideally police clearance from wherever he resided previously.

I had court hearing in 2004 and I never show up , I didn’t know about it .

Type in your A-number here and see what it says.

 

Since you didn't show up there's a 99% chance that the judge ordered you removed in absentia. There is also 1% chance that the judge threw the rulebook out and terminated or admin closed the proceedings.

 

If nothing pops up or you don't know what A-number your proceedings were conducted under then you'll need to do a FOIA with EOIR to see what they have and what ultimately happened.

Hi Mira, Your friend needs to prove that his marriage is legal as it would be deemed invalid if the previous union wasn't legally terminated! Therefore the i360 is missing the qualifying relationship requirement. The RFE states clearly what needs to be provided..Divorce nissi, and divorce absolute that's what makes it final! Secondly proof of good moral character from Nigeria as the one from the U.S. is satisfactory! He should write an affidavit that he's a person of repute with no criminal record etc or get police clearance from Nigeria. He can also add a few statements from family and friends affirming his pristine character. It's pretty much explanatory..wishing him all the best!😊
