Aside contacting the senator I am literally in the same situation as you, I did contact my congressman but got no response thus far. It'll be 2 years as of this Friday and I submitted my RFE response 89 days ago.

What in the world? 2yrs?😳 I guess I have not really paid attention to your story...but that's really weird! I truly hope your case is resolved!👍

Yeah this is my timeline thus far:

Filed I-360 (standalone since I'm in admin closed removal proceedings and I don't want to poke that bear just yet, and have EAD under DACA): 08/21/2018

RFE: 02/27/2020

Responded to RFE: 05/21/2020

Approval: Hopefully sometime soon

Then I'll have to recalendar and file I-485 with the court since I know that terminations are next to impossible to get these days.

Oh I see! From your statement in an earlier post..you said RFE since 2yrs ago..but you only responded in May of this year..which makes it normal..it's not uncommon at all. But quicker in less complex cases! Well I wish you all the best, keep holding on!👍

Well maybe I wasn't too clear on that part but I did specify that I responded to the RFE 89 (now 90) days ago. Believe me, if it was 2 years after an RFE I would've started a mandamus suit a year ago.

Got you..I'm sure you'll be approved any time now..they usually respond anywhere from 30-120 days..then in extreme situations..more! I personally heard back 60 days after RFE response! Hold the fort! It's coming!👍

Sharshar darling, I like your positivity..it goes a long way! Tell them how you were denied previously, and approved now! There's little that one can do if they let their spirit stay broken...we need to be strong and focused..it's the only way to win! It doesn't matter how long it takes, as long as it happens! Your story is very encouraging I hope someone..anyone is encouraged!😘😊👍

They asked for proof of good faith marriage and i submitted

3 lease agreements

water bills spanning almost a year showing that i lived there

Tax return listing  my spouse, as my spouse refused to file taxes with me

They asked for proof of abuse

I submitted Dr's notes showing swelling from my spouse slamming stuff at me and bruising my hand

I submitted psychologist evaluation and notes

I submitted pictures of abuse photos, thou i didn't submit the ones with too much blood

I submitted police report showing that my  credit was used without my consent

They asked for proof that we lived together

I submitted auto ins listing the address

Pictures of us and my spouse's children

a 15 page letter highlighting relationship from courtship to marriage and attestation from friends and family members

copies of my journaling from happy times to abuse times

I submitted letters i got from the apartment we lived showing that I owe for the damages caused by my spouse

I am so sorry.. wait for the RFE. Something might be missing but I believe you had provided them with sufficient evidences.. 😕

did you submit your divorce documents with your i360? I think it is somehow related to your 1st marriage

I got response from  the Senator office  that my case is under review with one of the officer. My petition I-360 is pending for the last 24 months and VSC received response for  RFE almost 93 days ago. My question is this unusual and I should get ready for adverse decision?  Please help me .

You will be fine. since USCIS has reduced staff, they are taking times in making decisions. Have faith. my case was approved after 23 months including an RFE. so stay there your approval is coming soon

Current guess is that, since she was previously married to a USC who petitioned for her and later withdrew it and they divorced and she later married the current spouse, USCIS wants things related to the first marriage which is why they denied her. We won't exactly know until the denial notice gets in the mail.

That's not true. I was also in removal proceeding in Dallas, Texas. After my VAWA approval, my attorney filed to terminate my hearing at Immigration court. First it was rejected and I was informed that I will have to attend the court hearing( this was in February 2020). Then in March, we received a notice that my removal proceeding was terminated. My attorney said this was most probably becuase of COVID19. They are trying to limit the number of ppl they have to see in person.

So I would highly recommend you to file for termination of your proceeding and file for your I-485 with USCIS then to file for it with Immigration Judge.

Good luck! your approval for VAWA is coming soon. 😇

Well I'll definitely try an MTT first, and then if that fails a MTRc and I-485 with court. Believe me, I would way rather deal with USCIS processing my I-485.

I really miss the days when you'd send an approved visa petition and some evidence that you're eligible to adjust (like an I-94, prior petition for 245(i), or just the VAWA petition itself) and the court would grant a motion to (reopen and) terminate on the spot without a hearing.
