Hello, I have been a silent reader for the longest time but now I have a question and hope someone can help! 

 

VAWA, I485- Dec 2017

VAWA approved- May 2019 (no RFE), I485 moved to local office
 

My I485 has been out of the processing times for the longest time. In December I reached out to the congressman and they made an inquiry. I was asked to send in Medicals which I did so I was ready to be scheduled for an interview. The congressman asked me to contact them again in 60 days if case is not resolved- which I did but I never heard back (Covid 19 times). A couple of months and a few emails later I reached out to the senator who also never replied back. So last month I made an online inquiry with USCIS, couple of hours later I heard from both the congressman and the senator (what a coincidence)- so now they had also made inquiries-> not sure if the immigration didn't get pissed

 

Here comes the weird part. A couple of days ago I got a call from the immigration- Field Office Chicago. They asked me where I live and what I work and they scheduled my interview over the phone. She would repeat the same questions over and over again and wasn't very nice really! I have never heard anyone else get a call for the appointment!

 

Does anyone have any experience with that? What should I expect? Also- can they detain you during the interview for any reason?

that's really a odd that she was making an appointment over the phone. I hope you get the appointment letter in the mail.

Did she give yo any conformation number?

Hi @Stillwinning!!!😊 I haven’t heard back from the usics since may they sent a letter that they didn’t have my medical to proceed. Heard not since then. Just got a letter from Vermont saying my work permit wasn’t approved which I got from last year from them so maybe that was a mistake. But what I’m wondering being that my daughter was approved under me through vawa. And she didn’t have a petition going on like I did at usics should I send in a new I-130 and adjustment form for her to them?

Do you mean that they already give you your appointment date over the phone?

Hi, the whole thing is pretty unclear to me..did you try bringing this matter to the attention of your representative? They probably would have gotten to the root of the matter...your i485 is pending right? Basically...👇👇👇

If you have an approved Form I-360, you are eligible to apply to work in the United States.  In addition, if you have an approved Form I-360 and have been placed in deferred action, you are eligible to apply to work in the United States. To apply to work in the United States, you must file the Form I-765, Application for Employment Authorization, with the Vermont Service Center.

Your children listed on your approved Form I-360, may also apply for work authorization.

Well that's unusual..at least to me..but hey these are weird times...so comply accordingly..go to your interview ready. You know the drill. Wish you all the best dear!👍😊

I have an employment card from Vermont office. I got my second I-130approval from the uscis office after vawa approved my petition which I said second because it was approved when my husband petition. I called but they said something like I won’t receive a call back until 70 something hours From an officer... my situation is so unbearable. I feel suicidal some days. I can’t use my card because I need to divorce and bring the paper to ss. So they can change my name but it won’t make sense. On the uscis my name is hyphenated maiden-marriage. So even before I pay money to uscis for another work permit I need a divorce and I have nobody to help mi fill out the divorce papers.

I am only who applied for I-360 solely. And last week I-360 is approved hopefully.

Did I made mistake I didn't apply in the same time? Would this make shorter time to get GC or no?

So now I have to wait approval letter first and then to apply for I485,right?

Or I can even today to apply?

  1. Where would I file I-485 and I-765, if I file them concurrently with I-360? I'm assuming the VSC, is that correct? 
  2. Is it better to file I-485 or wait until you have an interview and ask for abeyance? I filed for AOS last September, but I guess it might take a long time before I can get an interview date, and my spouse has been threatening me with divorce, ruining my career, and sending me back to my country. 
  3. If, next month, I file to renew my EAD (which is based on my I-485 and I-130), and then later I file VAWA (after sending my EAD renewals document), will my new I-485 affect my EAD or VAWA renewal or vice versa? 

 

1) VSC

2) Your i485 is pending so at the interview, ask for it to be held in abeyance pending when your i360 is decided.

3) Your subsequent EAD renewals will go to VSC and to the best of my knowledge will not affect your i485! Why should it though?💁

Thats unusual never heard of it.. but these days anything is possible. I hope it was not phone gc interview 😕
