Hey Everyone,

Sorry that I have not updated this in a while but I was waiting for the i-797 notices. 

Today I received the i-797 notices for the i-485, i-765, and i-131 with a received date of June 18, 2020 for each. 

The i-485 was filed on paper and the i-130 online. When I mailed the i-485, I sent a copy of the i-797 notice for the pending i-130 form and it appears to have been accepted. 

 

Also, because at the time I did not have access to my IRS transcripts, I sent a copy of my filed IRS 1040 forms with a cover letter explaining why I did not mail the transcripts. It appears that USCIS did not reject the application for failing to send the transcripts; however, there is still a possibility of an RFE. Another thing to note is that I did not send the Medical examination (i-693) forms with the application.

August 13, 2020 - Mailed RFE response to USCIS**

August 17, 2020 - USPS confirms that RFE response was delivered

August 18, 2020 - USCIS Notification confirming receipt of response for RFE

September 24, 2020 - Received I-693 Deficiency Notice

January 19, 2021 - Form I-130 Approved and notice sent to beneficiary with notice available immediately online

January 22, 2021 - Form I-130 Approval Notice received by mail

January 29, 2021 - Biometrics notice received for the I-485 and I-765 dated for February 17. 2020 at 1pm

February 17, 2021 - Code 3 Biometrics taken for I-485 and I-765. Case updated to show biometrics applied to both I-485 and I-765 the same night. 

February 18, 2021 - I-485 case status changed to "Ready to be scheduled for interview" 

April 19, 2021 - I-765 case status changed to "New Card is Being Produced"

April 20, 2021 - I-765 and I-131 case status changed to "Case was approved"  

April 22, 2021 - I-765 case status changed to "Card was mailed to me"

April 23, 2021 - Approval notices received for I-131 and I-765 via mail

April 23, 2021 - I-765 case status changed to "Card Was Picked Up By The United States Postal Service" with a delivery date set to Monday, April 26, 2021, by 9:00 PM

April 26, 2021 - I-765 case status changed to "Card Was Delivered To Me By The Post Office" and card picked up in mail box

April 29, 2021 - Visit to Social Security Administration for SSN Card

May 4, 2021 - SSN Card arrives in the mail

*Packet was mailed without I-693 medical. Will wait for an RFE and take it to the interview. Also, tax transcripts were not available at the time so copies of the tax returns were sent and a cover letter explaining why. 

 

**Included tax transcripts in RFE response since I was now able to gain access since sending the application.

Hi, I was wondering how you organized your documents. My husband and I are filing for his AOS from TN visa. I'm the USC and he is from Mexico. Any advice you can give about the organizing of your packet would be appreciated!

This is more or less what my packet looked like. Also, you want to put the payment method at the very top of the packet:

 

In my case, I filed the I-130 online so my packet may look different than those who file on paper with the I-485

To add to my prior message. Although I included the I-130 NOA in Exhibit A, it was also placed on the very top of the packet with a simple notice stating that the I-130 was already filed and pending and that this packet was being sent to file concurrently.

Anywho...I e-filed the I-130 on June 9, 2020 and on June 10, 2020, I received a notice saying the application was accepted and is being processed with a priority date of June 9, 2020. I was also able to download a PDF version of the I-797 immediately. USCIS also mailed a copy of the notice and I received that on June 15, 2020. Also, I live in California but it looks like the efiled form is being processed at the Texas Service Center.

I did it this way because I was still waiting on some documents for the I-944 and wanted to get the process started. Also, because I was able to upload all of the documents for the I-131 online and even pay the fee online so it was one less packet to mail and worry about. 

 

Another reason I did it this way is because I couldn't find many threads of people who have done it this way so there are not many experiences. Also, you can still file the I-485 in Chicago "concurrently" but you have to send it in with a copy of the I-797 notice for the I-131 showing it was accepted. 

I will be sending the I-485 shortly and will update with what USCIS says. I have a cover letter and a copy of the I-797 near the top so they know I've already filed the I-130.

 

So, I will update this thread to see what happens and if you've done it this way as well, maybe put your experience with this.

We did it this way aswell.  Filed I-130 online in august, and filed AOS by mail in October.  However, maybe you can answer this.  We recently received a notice of action saying the I-130 was approved and sent to the NVC and that we can login to pay the affidative of support fee and the IV processing fee however the AOS

psckage is still pending..?  Do I just continue to wait at this point?
