Timeline

Hello! I filed for the K1 back in March as a Peace Corps Volunteer in Morocco, right before we were evacuated due to COVID-19. I should be getting my NOA2 within the next couple months and then hopefully the Consulate will be open in Casablanca so my fiancé can move forward with the interview. If he has an interview this year, I know I have to use my 2019 tax returns. I only made around $5000 last year as a PCV in Morocco, which is obviously way below the federal poverty line. However, I start my federal job next week where I will be making way over 100% of the federal poverty line. How would you suggest filling out the AOS? I really don't want to use a joint sponsor (even though my dad would say yes if I asked him), but I am just worried about my 2019 federal tax returns, that the officer will look at them and immediately reject it. Should I even include them in the AOS or should I just submit pay-stubs of my current job? You will complete the I-134 with your current income. Presumably you will have started the new job and be earning more at that time. You will need to include evidence of your income from the new job, such as pay stubs.

 

The CO will look at a totality of the circumstances - your current income, your tax return(s), their age/health/work history/etc - and make a public charge decision based on that.

Personally, I would suggest having an I-134 from a co sponsor prepared to be presented at the interview if requested. Morocco tends to be pretty strict in general, and I believe they are so with the public charge issue as well.

Edit: By 'way over", are we talking like 125% of the FPL? 250%? More?

Okay- that is great advice. I can send a back up co sponsor i-134 with my fiancé.

For a 2 person household i am around 400% over.

Thanks. I would still have a co sponsor ready for the interview since Morocco tends to be pretty strict with past income.

Then once they get to the US and you do AOS (I-485), the I-864 should likely be fine solo. That way your sponsor isn't ever legally on the hook (the I-134 is not enforceable), and current income of 400% or more with USCIS is a heavily weighted positive factor.

Timeline

Don't expect an interview in  Casa till 2021 /  not sure why you think this year 

be sure you do your 2020 tax returns ASAP and have them ready for the interview if possible
