I-864 A income question if sponsor files jointly

Hey guys,

I am just about to finish my package and I am curious about filling out the I-864.

 

Both my mom and stepdad will co sponsor my spouse; however, on the form, it seems to ask for individual income. So what I did was filled out a separate I-864 A form for each of my parents, put in their individual incomes, and attached a copy of the jointly filed transcripts. Is this correct?

Do you live with your parents?

if not, one of them will complete an I-864 as a joint sponsor. The other will complete an I-864A as a household member of the joint sponsor.

We do live on the same property. They have multiple buildings on their property so we share the same address with different unit numbers as per USPS.

My understanding was that I, the USC Spouse, needed to file the I-864 and any additional sponsors file form I-864 A. Did I do that wrong?

To qualify for an I-864A, the individual must have "the same principal residence as the sponsor". I don't know your situation well enough to determine if that does or does not apply here, but to me (and my history with USPS) generally different unit numbers means you do not share the same physical residence. You're just in the same building or plot of land. But that's your judgement call to make...I don't know the specifics in your case.

 

Just to try to clarify things, there is a primary sponsor, an optional joint sponsor, and included household members (if available).

The primary sponsor (the petitioner) must always provide an I-864.

A joint sponsor provides an I-864 in addition to the primary sponsor.

Income & assets cannot be combined across sponsors. Each is evaluated independently. Each has their own household size.

 

A household member lives in the same primary residence as a sponsor (primary or joint). They can combine income/assets with the sponsor via an I-864A.

If they do qualify as household members, then you would provide an I-864 and either:

1) They each provide an I-864A to join income/assets with you; or

2) One of them provides an I-864 as a joint sponsor and the other provides an I-864A as a household member of the joint sponsor (I'm assuming they live together).

I'd suggest doing whichever one works out better in terms of income/assets and household size.

 

If they do not qualify as household members for you, then you would have to follow option #2 above (I-864 from you, I-864 from one of them + I-864A from the other).

So we all live at the same address as far as USPS is concerned even though they are different buildings. I am filing as if they live in the same address.

So I filled out the I-864 with my proof on income then did option 1) They each provide an I-864A to join income/assets with you and included their transcripts. I just wasn't sure what the big difference with the 864 and 864 a was
