Hi there,

Vitals: Married to Englishman, want to leave the UK forever

Status: I-130 is through, on pack 3 now.

I'm stuck on the I-864 at the moment. Presumably my UK wages aren't going to be relevant to the process. So, do I just put 0/0 on all sections of the form? Do I still need to include my tax return and UK P-60? My mother is co-sponsoring my husband and is filling out the form in the US. We're relying on her household income to meet the poverty guidelines.

If I've missed some guidance about this somewhere, please feel free to point it out to me. The forum search didn't seem to turn up anything and I haven't been able to get a straight answer from the embassy website.

Your UK wages are relevant to the extent that they show that you are in the working world and your earning capacity, so if you've been working and earning an income there's no reason to hide it even though it is not sufficient to avoid the need for a Joint Sponsor.

Also, get in the habit of answering questions as asked - don't get into second-guessing underlying meanings, that can lead you astray sometimes.

From the (limited) information that you provide it seems that your husband is applying for an immigrant visa, not a K3 visa?

Honestly? I have no idea what kind of visa I'm applying for. I followed the clicky link on the embassy site and started the process from there. *I'm* guessing it's a K3 with spouse of US citizen. Maybe.

However, that has nothing to do with my question about the I-864 and how to fill it out. Have you filled out the affidavit of support? Were you in a foreign country with no assets in the US? Were you relying on a co-sponsor?

I'm presuming nothing. I'm asking questions so I can make educated assumptions and proceed from there.

Now, has anyone on the board in a foreign country filled out this form? What did you do re: your income?

You were given the answer. Put your income on the form and supply your US tax returns. Citizens are required to file US tax returns even if their tax liability is zero. If you haven't filed the returns, get them filed. Of course you would not put zero for income. That would be a lie. Never lie in the visa process.

If you need an I-864 instead of an I-134, your husband (not you) is applying for a CR1 immigrant visa, not a K3 visa.

You petitioned for the privilege of your husband applying for a visa.

Yes, you ARE presuming. You're presuming the people answering your questions are not qualified to do so. Get hold of yourself. Calm down and look at the process logically, if success is your goal.

You are not applying for any kind of visa, you don't need a visa. Your husband is applying for the visa.

One doesn't have to know all the rules to start playing the game, but one does have to know the name of the game to find the appropriate rule book.

Yes, I have filled out an I-864 affidavit of support, yes it showed foreign-earned income from when I was an expat, no I did not require a Joint Sponsor. (Because I was back working in the USA again before my wife applied for her visa.)

As someone who just yesterday was at the London Embassy handing over an I-864 with my UKC husband, I can tell you the following. I wrote down that my income for this year is $0.00, because I am employed full-time in the UK, no US earnings whatsoever. I toyed with the idea of writing down my UK earnings in dollars, but in the end I stuck with zero. I supplied a letter from my line manager which confirmed my salary in the UK, but the letter was primarily concerned with my conditional resignation from my job, as part of my proof of re-establishing domicile in the US. The consular officer had no interest in how much I earn over here -- she said it was US income only.

We had my mother as joint sponsor, and as she earns more than enough to support herself, my dad and my husband, this was fine. No mention was made of the fact that I had put down my income was zero on the I-864. I presented tax returns for 2004-06, all showing pittances that I technically earned in the US due to days I worked for my UK employer in the US. You do not need to produce P60s. Now this may not be the case for other embassies, but this is the situation in London as of yesterday.

You really should find out whether this is a K3 or a IR1/CR1 visa that your husband is seeking. It is a big difference -- the K3 visa will require adjustment of status to permanent resident after entering the States, which takes time and costs money. The IR1/CR1 visa doesn't require this adjustment. Have you filed an I-129F? If so, you've applied for the K3.
