Hey all VJers,

I needed a clarification regarding the marriage certificate address. My fiance is a naturalized US citizen while I am an Indian citizen. We were planning on having a small civil ceremony in his home town, Mumbai in India in July. We just got to know that his address on the marriage certificate would be listed as the Mumbai address and since I am from Goa, mine would be listed as the Goa address. Would this make a difference while submitting the application for K-3? Since his address on the visa forms would be his US address.

If this would create problems for us, we could still get the marriage registered in Goa, in which case his address would be listed as the US address.

Please advise on what we should do and if anyone has faced this issue before.

Hi.

It doesn't matter that the addresses on your marriage certificate are local ones. The only thing that you want to make sure is that the names are spelt exactly as they are on the passports. I had the same problem and the consulate didn't have any issues with that. I also used the same marriage certificate for all the other purposes here in the US and still haven't had any issues!

Another piece of advice.............. If your husband is a US citizen, why are you going the K3 route? Why don't you apply straight for CR1 using the I-130? In my experience the K3 and CR1 takes pretty much the same time to get approved. Even if the K3 takes a few weeks less, it is a hassle to again apply for AOS, EAD etc etc. Also, all of these will end up costing you plenty of money, which is a total waste in my opinion. The CR1 is fairly quick and you will not have the trouble of going through all the rest of the procedures.....................just my 2 cents............. Good Luck! I would suggest to apply for K3 because it is faster, CR1 and K3 taking about the same time is just a luck of the draw, but usually the K3 is much faster. Even if CR1 get approved in the same time as k3 there is a lot more process for CR1 after the approval delaying it another 3 or 4 months where as k3 goes to the local embassy pretty much immediatly after approval.

Wat ever you decide to do, good luck with it.

Using local address on marriage cert is no problem. Many places require a local address to register a marriage in that jurisdiction, USCIS has no problem with that.

No problem with the marriage certificate but I would carefully examine timelines and your own priorities before deciding between CR1 and K3. While the petitions themselves take virtually the same time to be approved, the process after USCIS approval is usually months longer with the CR1. Overall, the CR1 is far less expensive by all measures but you must weigh the extra 4 to 6 months separation against the rest of the factors including your own priorities.

Facts are cheap...knowing how to use them is precious...

Thanks for the help !!! So I guess we will go ahead with registering the marriage in Mumbai then, since the address doesn't seem to cause issues with the USCIS.

And regarding the K-3/CR1...we just thought we would file for the K-3 visa because we also came to the conclusion that with the CR1 the wait would be longer after the petiiton got approved, while with K-3 its less wait. And we really do not want to spend time apart more than what is needed. We are also hoping that we will be able to send the I-130 out before the July 30th deadline for hike in fees. :thumbs: As far as expense is concerned, yes the K-3 will be more expensive but atleast we will be together earlier, God willing !!! :)

Good luck. Yes, being together sooner is usually the reason people go the K3 route.

Lack of understanding of the NVC and Consular process is often the reason people mistakenly think there is little difference in time apart between CR1 and K3. It's best to gather all the facts before acting.

One of the things I actually considered was that even with the best possible CR1 timeline by South China wife would be arriving in the dead of a cold winter instead of a beautiful late summer. I wanted her to adjust to the climate change more gradually instead of it being such a shock. So far, so good.

Others have different priorities. Working right away was not a priority for my wife. For couples where the immigrant is a major financial contributor, several months off work can become very expensive.
