My wife & I filed in January 2019 to remove conditions on her Green Card, had biometrics done that April and we just received (May 2020) a RFE that we didn't submit enough evidence of entering into a "good faith marriage."

We originally submitted:

-Proof of joint auto insurance

-Bank statements/Credit card statements of our joint accounts

-Tax Returns(but only included the first page w/o signatures)--Didn't realize they needed to be hand signed

-Beneficiary declarations for both of our 401k

We are planning on send

-Utility bills (they have always been in my name only and have just put my wife on)

-Affidavits by two close friends

-Resending tax returns for last 3 years with the signatures on the first page.

-W2s from our employment to show that we both live at the same address

As far as residing together I already owned this home before we were married so she isn't on the loan or deed. We prefer to keep most of our finances separated and while she's only just been establishing credit in the last year, most of our bills are in my name.

My questions for you experienced folks:

-Do the affidavit letters absolutely have to be notarized?

-Will the first pages of our tax returns signed be enough or does the entire 100 page document need to be included?

Any other advice on evidence to send, photos, etc?

I had the RFE as well on remove condition, and i sent in everything from her Rx bottle with our address to the title of our cars. and i have like 4 friends write letters and I did not have them notarized. Tax return i would just include the tax form (like 1040) only ( not the worksheets  come with them. i also included many photos within the two years including dates and descriptions.  just send in as much as you can and should be ok.

I just tried to get my 2019 transcript.  I signed on to the IRS.gov site, put in my ID and password, and then it asked me for a verification number that they sent me by snail mail over 2 years ago!!!  Like I really have that handy, right????   So I tried to request another verification number (where I will have to wait until the mail gets it here) only to find out that they are not sending ANY mail at this point.  No mail transcripts.

All this because they don't have my telephone number on file.

So if your online request does not go through, you are hosed.

If the OP cannot get transcripts, s/he needs to send ALL the pages of the tax returns PLUS copies of any W-2s (or other wage statement) to address the RFE (if the RFE specifically asked for that).

I tried too just now after I saw your post. I log in with my username and password, then I'm supposed to receive a code to my phone. The number I see on the screen (only the last 4 numbers) are correct, that's my phone number. I'm still not getting the access code though, no text messages from IRS seem to be going through.

If I don't have the IRS  transcripts, can I print out my complete tax returns from Turbotax?

Yes.  And please, send the WHOLE return - even if it is lots of pages.

This is unfortunate! I am concerned because we filed back in September 2019 and IN CASE RFE comes it would be nice to get the latest tax transcript for updated evidence. I also read on IRS website today that they are no longer sending mail due to COVID. I’m just praying we don’t get an RFE lol. Thank you for your help!

I think a part of the reason why IRS can’t verify your phone number is if you have a prepaid phone plan. This is my issue since i’m not on a contract. Seems to be way too strict and nearly impossible to get any downloadable transcripts, especially now that they don’t mail physical copies. Oh well

Wow! I had no idea you have to sign the tax returns and notarized the affidavit.

We didn't do any of those. We printed one month of bank statement for each year since we got married (my husband picked the month randomly) and of course the most recent month before we applied. I just got interviewed and approved yesterday. Good luck!

My husband owned the house together with some of our vehicles prior to marriage so I was not included in the title and in some of our utility bills as these were established prior to marriage.  Also, my husband didnt like to have any credit cards and ONLY uses a Tracfone since he doesn’t really like a postpaid cellular service.

I did send some of my credit card and AT&T statements under my name only andI explained this clearly in my cover letter that way the officer will understand why Im not on some of our bills.

I hope this helps and good luck!
