My wife is a USC and we are concurrently filing marriage based green card for me.  Unfortunately she got a news that her employment is going to end on June30th.

Can we still go ahead and file the i-1864 before June30th by taking employment verification letter from the current employer?

What if by the time we send the whole packet we cross June 30th by a few week or so? 

 

She has also started a business with her sister, which recently picked up and I dont think the income from that has gone past $21,550, but it will cross that before our interview date if we reach that stage. She will file her first tax return this July with that business income. 

Her parents own a house but they are still paying mortgage on that house. can she use that as an asset?

The I864 needs to be accurate the day you submit it. You submit it now you are good (for now)- you submit it July 1 her current income will reflect $0 and will need joint sponsor. By the time of your interview you will need an updated  i864 as it must be accurate- either way best to look for joint sponsor. Her PARENTS “own” a house so no SHE can’t use that. Also - the parents don’t own it, the bank does, as they have a mortgage. Self employed income is looked at differently so don’t assume she can use that to meet the guidelines. Start looking for a joint sponsor if she doesn’t Obtain employ after June 30.
