N400 3 year vs 5 year

Hi all,

 

I have seen people talking about filing via 3 year (via spouse) or 5 year.

 

1) What exactly is the difference in the actual application? 

2) What does the 3 year require of the US citizen spouse? Proof of marriage/spouse interview/photos? All the joint utility bill ####### etc?

March 16 2021 - Interview & same day Oath Ceremony, Ft. Myers FL - Officially a US citizen!

February 8 2021 - Interview Scheduled for March 16th

January 20 2021 - Received Biometric Reuse Letter

Only a spouse of a US citizen can apply for naturalization after having a green cats for 3 years. You must show proof of your relationship during that time- so basically the stuff you submitted for removal of conditions and any new documents.

There is a checklist of required evidence that USCIS provides https://www.uscis.gov/system/files_force/files/form/attachments.pdf?download=1
 

You can see what additional goes with an application by looking at the section:

“If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:”

 

It’s mostly things showing you are married, much like the removing conditions evidence...tax returns, leases, children, joint accounts. Not so much photos. You do need to prove the spouse is a USC again and previous marriages ended. Have a look at the checklist for the extras you supply when based on marriage.

 

My interviewer did not mention the marriage or want to see any of the original documents I was instructed to bring to interview (marriage certificate, etc). I guess it depends on the officer conducting the interview.

I will add that mine was fairly minimal because I just sent my most recent joint account statements, more of a carry-on from what I had sent for ROC the year before. I didn’t cover the whole three years of joint documents since ROC already covered two years.

For the USC spouse what sort of evidences do they want a copy of birth certificate or a valid US passport? Additionally, when filing after 3 years and completing the work/employment section do you advise doing 5 years or 3 years worth of information as you would be filing based on the past 3 years as a LPR?

Mailbox was full, but I hadn’t noticed. Deleted some.

 

USC spouse—It’s all listed on the checklist what documents prove he/she is a USC. Click the link I posted. About halfway down the first page.
