long story short, this happened 2 months before my B2 visa interview and I couldn’t cancel and I went ahead to attend the interview since the purpose of my trip at the time was important. (I was working for the Lagos state government and they needed me to attend a conference)

It's the new norm in my country......thereafter, comes the "Certificate of singleness or Bachelor's certificate," a certificate which:

 

1. Never been heard of in my country until US immigration is involved. Infact, it doesn't even exist. No unmarried Kenyan holds such nor has ever held such.

2. Is just a patch, devised to try and salvage a sinking ship.

3. Will have all necessary and authentic stamps, courtesy of forgery artist on the streets of Nairobi. 

Lastly, I tend to believe US Embassy Nairobi already know about this game.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Many people on VJ know this game, would seem odd if the Consulate did not.

That is not a document proving termination of marriage.  Consulate officer know all the tricks and lies.......We normally never find out how (or if) these misrepresentation cases are resolved.....please keep us updated.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I bet they do and very soon ...increase in visa rejection rate will also confirm it

Half backed plans....very myopic . what if they dont get the visa?...they get stuck with fictitious marriage???

Yap, which makes it had for the rest.

 

Additionally, when caught, they'll say a cyber agent filled out the forms for them. Really? A higher percentage of Kenyans have smartphones. Visa application can be filled on them, right from your living room. I don't know how they think concocting the cyber agent story makes their story believable and that the CO will give them a pass based on that.

There's 2 major potential (likely) issues...

 

1) SInce you claimed to be married on a previous visa application, signed under threat of perjury + affirmed by interviewing while under oath, they will require proof that the marriage was dissolved. They will not issue any sort of family-based visa (specially one for a fiance or spouse) until this is received. Just saying it was a lie is insufficient.

 

2) Misrepresentation carries a permanent ban on any visa. This can be waived with an extreme hardship to a qualifying relative. It also may or may not apply as it sounds like the visa was not issued and therefore the lie may not be deemed material.

 

Item #1 is the big issue. There's quite a few similar cases on VJ...it's not a unique situation. But a solution to get around #1 has not been reliably reported.

USCIS will want to see the divorce decree from the first marriage (you know the one that you lied about but also.. didn't lie about..). 

Yeah I don't see this happening. Have your new woman move to you in Nigeria, because I'm 99% certain you won't be coming to America. Not as a visa holder, not as a greencard holder. Wasted money if you ask me, but it's obviously your choice if you want to give it a try.
