Hello Everyone,

I would like to know what are the requirements to file adjustment of status? My daughter- in- law has 2 years Temporary Green Card status issued in 2017, and now she is up for applying the Adjustment of Status for 10 years GC. Please if someone had experience on filing this form and the requirements needed? I appreciate your help! Thanks!

Its not adjustment of status but removing conditions.   An entire forum dedicated to this process exists

She should have filed for removal before the conditional card expired.  If she has not already filed for Removal of Conditions, her status is in danger due to failure to file the I-751.  She needs to do some research ASAP!!!!!  I would suggest she consider consulting an immigration attorney to help resolve the late filing..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Step 1: Make sure she has not been issue a NTA for immigration court, or actually had an order for removal made against her (very unlikely in that timeframe, but anything's possible).

Step 2: File the I-751 ASAP.

 

Why does she only have a 2 year green card? Did she immigrate via a spouse? Is she still married to that spouse?

Her conditional card was issued in 2018......not 2017.

She really needs to study the guide (link posted above).  Answer: The I-864 you signed is still in effect.  You have no part in her removal of conditions.

No you don't need to do anything. She needs to fill out the i-751 with her information as the petitioner in this case, and her husband - (he is the sponsor you are the joint sponsor), not you, will sign as well.

  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)

Ah, so she isn't even late yet. The original post said she was issued a 2 year green card in 2017, but it sounds like the card wasn't issued until August 2018.

 

Just follow the guide above. She needs to file anytime within the 90 day window prior to the card expiring.

You are the joint sponsor; your son will always be the primary sponsor regardless if he has an income or not. Please clarify that her GC was issued in 2018 as you first said it was issued in 2017. You no longer play a role in completing any immigration documents for her.. unless she becomes a public charge.
