Obtaining illegitimate fathers death certificate

My wife was never previously married. She had a son, now my stepson, and soon after my stepson's father died.

 

My wife and stepson's cases are DQ and we are waiting for an interview. I plan to adopt my stepson after he is in the USA. My research indicates I will need my stepsons late father's death certificate in this process. My wife says she can not obtain this because they were never married. 

 

Is there any way my 6yo stepson can petition to receive his illegitimate fathers death certificate? They actually do share the same surname if that helps. My wife insists that we will need to wait until my stepson is 21 before he can petition to get his fathers death certificate. That seems incorrect to me.

 

Do you think we will need a lawyer in the Philippines to get this?

Is the father listed on the child's BC ?    If he is, I would think its possible for PSA to issue a copy of the death certificate in that case.

 

Why not try contacting the deceased father's parents or siblings to acquire a death certificate?

My wife and her late boyfriend's family aren't on good terms. They will not help us.

Why does your wife say that not having been married is a problem? The rules for getting a death certificate are much less strict than getting a birth certificate. https://www.psaserbilis.com.ph/Secure/OnlineApplication.aspx

Then that should allow the child to acquire a copy of the death certificate from PSA.  Being his mother is the custodial parent she be able to complete this request by presenting a copy of the child's BC.
