In your other thread you said you haven't mailed your AOS packet yet. If this is about a simple name change, like taking your spouse's last name, you simply file using your new name, and include your old name under "other names used". Your marriage certificate is the court document that supports the name change. This is how I changed my name (my maiden name is now my middle name and I have my husband's last name). I received my EAD and later my greencard in my new name, which I then used to update my social security card, etc.

Unfortunately the name change would not be so simple as I would have to get a court order first (changing more than just my last name.) The timelines for doing that are not ideal (can take like a month in our state) considering we're already late and wanting to file our AoS as soon as possible.

I am not sure if I can ask a question here or if I am meant to post a new topic, or if that new topic will be an unnecessary one because one (i.e this, already exists.) I also want to change my surname, not to my husbands. I delayed this process and obviously I should have done it before the GC process. I have my visa now and in the US awaiting Green card. Do you think there is a chance to have my name changed or will I have to do it sometime later once the GC has arrived?

You can go through court to get your name changed. When you receive your greencard, you file a i-90 to update your name on the card.

I don't think you can do it in the UK. You need to know if the US will accept the court order from the UK. Every country works differently.

 

For example, the court order that I got in the US is not valid in Brazil, so I'll never be able to change the name on my passport until I go through the same process in Brazil or get citizenship.

 

My court order in NYC costs 65 dollars. But in some states it can get to 300/400.
