Hi,

 

apologies if I’m cross posting, I’m new to this section of VJ.

 

I was wondering if anyone has experience of successfully expediting the EAD and could offer some advice and or wording from letters etc?

 

 We began our journey last year through consular processing, and were due to complete everything before Covid-19. I’m now in the US and have applied for AOS, however would like to work ASAP, I’ve now been out of work since Feb and I’ve a provision job offer that I’d like to take up. As a side note, I had a job offer previously before however this was rescinded when the embassy shut down, so I’d rather not lose a second.

You can ask your prospective employer for an offer letter and then file expedite request via USCIS hotline. If it’s being granted at the moment I don’t know, but expedites have certainly been successful with proof of an actual job offer.

Get the offer letter in writing, then call USCIS and request the expedite under severe financial loss: https://www.uscis.gov/policy-manual/volume-1-part-a-chapter-5

If they ask for evidence, then when you would submit the letter.

 

Note that "The need to obtain employment authorization, standing alone, without evidence of other compelling factors, does not warrant expedited treatment. ". This means needing an EAD to work is not a basis for an approval. If you have evidence of other factors to merit an expedite, I would include those as well.

job offer letter should be a good start. A simple letter telling them that you have a job offer and you need EAD to work and can lose the job offer if EAD is not expedited

I applied for an expedite last night and received a response this morning stating that my case is in suspense until they receive biometrics and that I’m in a queue. 
 

I called USCIS earlier as the website states that ASCs are closed and the lady I spoke with advised that they are in fact open. I’ve two questions.

 

1) Are the ASCs actually open and processing biometrics

 

2) How long does it take to have a biometric scheduled? I’m filing from D.C. if that helps.

The ASCs are not open, but the Field Offices are.  Unfortunately, the ASCs collect biometrics.  Provisionally the ASCs are stated to re-open on June 22nd, but I've read elsewhere that they may not be fully operational until mid-July.  What may happen is that they open on the 22nd June to get appointment letters sent out (but that is a personal guess and only that).  That said, USCIS is holding a webinar today about the reopenings, so expect some news about the ASCs within the next 24 hours.  

Generally biometric appointment letters come within a few weeks of your first NOA for your AOS case.  Obviously that's not happening at the moment.   
 

I'm sorry that you're going through this at the moment.
