Hello guys,

 

I have some questions regarding the AOS household size when using a co-sponsor.

 

Let's say my household size is 4 (Me the beneficiary, my wife the petitioner and my wife's two U.S Citizen kids) and we're using a co-sponsor that is not married and has an adult U.S Citizen son that's not dependent on her.

 

1) If my wife were to be the sole sponsor then our household would indeed be 4. How do we count our household size with the joint sponsor included? Is it still 4 or is it gonna be 2 aka just me and her (the joint sponsor)?

2) We gotta meet the 125% Poverty Guidelines threshold so that means we'll have to count a household of four or is it two?

1) Your wife's household size is not impacted by having a joint sponsor. If it was 4 solo, then it's 4 with a joint sponsor.

Similarly, your joint sponsor's household size is not impacted by your wife's household size.

 

2) Not sure what you mean here...

For your wife to file as the only sponsor, her income must be at least 125% of the FPL for her household size. Under = cannot be approved. Over = judgement call by the IO based upon a totality of the circumstances (https://www.uscis.gov/sites/default/files/policymanual/resources/Appendix-TotalityoftheCircumstancesFramework.pdf).

 

If she uses a joint sponsor, she would still list her income and such, but she does not need to meet any sort of income level. That's what the joint sponsor is for.

The joint sponsor must meet 125% of the FPL for their household size for consideration.

The joint sponsor will sponsor only YOU and possibly his/her child if under age.

The joint sponsor will complete the I-864. They will complete Part 5 and see their household size as a result. The main point is to never count the same person more than once.

It could be that their household size is only 2 (themselves + the person being sponsored). It could be higher, such as with kids, dependents on their taxes like a parent, previously sponsored individuals, etc.

The Joint Sponsor will fill out his/her own application and count you as a member of household size... Your wife will fill out her own application including YOU. 

So, your wife household size is 4( you+her+ 2 childs).

As you need the Joint Sponsor, his/her household size will be 2 or 3(her + you and/or child)
