I-134 and Supporting financial documents help?

Hi everyone, even though the Montreal embassy has not yet reopened, my fiancé and I are starting to prepare documents for the interview since we’ve received our NVC case number. I know that for the interview we have to provide Form I-134 and supporting financial documents for the K1 visa. The issue is - I graduated university in 2019 and didn’t start my job until September 2019. I didn’t have to file before 2018 and I only have 2018 and 2019 tax returns. In my 2018 return, I obviously don’t make enough since I was still a student but I made about $24000 in my 2019 tax return (even though my actual salary is almost triple that), and which is about $3k more than what is required for the fiancé visa income requirements. However, there was an issue in filing my taxes this year due to Covid and therefore my tax refund and therefore tax transcript is still processing with the IRS. I already have my 2019 tax return that shows that I made $24k in 2019, but will this, along with My paystubs and offer letter showing my Actual annual salary be enough for the interview? Or should I wait for my 2019 transcript too? Thanks

They are interested in your income now. An employment letter will suffice. Print your 1040 and provide the supporting documentation if you are unable to get a TT before the interview. Be sure to have the following:

 

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both, the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g. letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.). Your 2019 income exceeds the 100% poverty guideline requirement. So as mentioned by greenbaum, 2019 W2 and a letter with your salary and employment status should suffice. 
 

Although I would recommend that if you don’t have the transcripts by the time of the interview, to see if you can get a joint sponsor. Some COs could be difficult and might not accept anything other than a transcript which was the case for us. Your fiancé could use the joint sponsor just in case if the CO doesn’t accept your W2 and the letter of employment. It’s better and faster to try get the approval right at the interview and not have to deal with the dreaded 221g.

Thanks! Do you mind telling me which country you were dealing with? My fiancé is in Canada and I’ve heard they usually don’t ask so hopefully it might be fjne

Since you have not completed your profile, we don't know the country to which you will have your interview. Each embassy is different in what they require. Some don't even look at financials' others it's a big deal and requires in most cases a co-sponsor.

 

We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. Whether the embassy ask or doesn't ask for financials it's still their prerogative to require financial documents. In the P4 letter from US embassy Canada they ask for the following and I quote:

 

m. Evidence of Support (I‐864; I‐864A, I‐864EZ, I‐864W) and photocopy of IRS transcript or photocopy of the most recent Federal income tax return (for family-based cases)

 

Now I never understood why they ask for a I-864, Affidavit of Support when most other embassies ask for the I-134, Affidavit of Support but never the less you must supply what they are requiring.
