Plenty of people have with an existing visa or VWP.  So if you already have one you can use it.  Be able to show ties back to "home".

 

Pretty hard to get one once you have announced your immigrant intent.  $160 and an interview is all it takes to find out.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I cant they dont give to Iranian any tourist visa but its not fair i miss my husband its been 1 year and 10 months

Unfortunately almost everyone in family immigration has to endure time apart.  A few stay together in the beneficiary's country or, like us, lived in a third country together.

 

A year and 10 months is long.  Please fill out a timeline so we know how long each step has taken and you will het better advice.  Also correct your "filed for" to not be DCF.  Clearly if you did DCF you would have been done by now.

Traveled multiple times to the US during my still pending CR1 process.

Just bring a copy of your Noa1 and if you have it your Noa2 and make sure you always book a return ticket. I even had my employer writing a letter stating I would come back to my country because I still work there.

I never had to show the documents, but if they do ask questions you can always show that you are returning and your filing the right visa.

Feb 14 2019: Send I-130(a)
Feb 19 2019: Delivered

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..

I renewed my ESTA during the CR1 process, it wasn't a problem at all. Maybe when you reached the NVC stage it is I am not sure of that.

Feb 14 2019: Send I-130(a)
Feb 19 2019: Delivered

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

If you already have have VWP or a B1/B2 you can definitely visit and usually renew as you already have a positive record.

 

Getting a new B1/B2 and other NIV during a petition is the issue.   The beneficiary has already signaled immigrant intent.

If you already knew the answer in your own personal case why would you bother to ask a completely generic worldwide question?  Yes, people from other countries can do this.  Now that you have this information does it make you feel better or worse?
