I just got  RFE's they are saying something is wrong with our Marriage licence.  I think our layer sent in a black and white copy could that be the only thing?   also something about the daughters Birth certificates.  Any Help will be greatly appreciated.

you need Apostille on your originals, then do a good, clear copy. Instruction doesn't say they should be in color, but probably they don't believe your originals are real.

this is what is there on DOS  https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Tajikistan.html. You need to meet the guidelines specified here . The reviewer will go by what is on this page

you need Apostille. They don't believe your documents are real as I already said. If you send the same copy again, they will reject your petition. If you do have apostille, they will believe the documents are valid.  Notary stamp doesn't validate a document for other countries. If you could scan and send your RFE here without your name? Just the part where it talks about documents.

I submitted my Russian marriage certificate without any apostilles and have never had an issue, we were married in Russia and our marriage certificate looks like exactly like the one the OP uploaded. My husband is currently waiting for Naturalization and we've never had an RFE asking for an apostille. So unless the rules have suddenly changed, it seems weird that this would be it.

 

 

@Wcalmt1 Can you scan the RFE part so we can see exactly what it says?

It doesn’t matter if  you submitted with Apostille or not. Maybe they believed your certificate is real and they didn’t believe it was, in that particular case. If they say the marriage certificate is not valid for the purpose of immigration, it means they don’t believe the document is real. Maybe the stamp is not clear,  Maybe they assume  it’s fake? Maybe someone has a friend in the registry office, they paid and got this paper. Nothing bad about apostille. It only proves the validity of a document outside of the country it was issued in. I’m not saying this document is fake, just giving you an example.

After examining the translations, I lol'd like I can see why.   The birth certificates all had the same error,  " the department of the division for "righting" civil..." they should say "Writing".   And the marriage certificate translations omitted the "ZAGS "  need new and better translations.   Any recommendations?

Whatever you mentioned “writing or righting” are both incorrect. They can read certificates in Russian. They have staff who speaks Russian. I assume If the problem was in translation they would‘ve stated so. You need to follow what they say in RFE and give them what they ask for. If you are confident the problem is in the translation, hire a professional to do it for you. It’s an easy job for a translator, just a standard document.

We rarely ever used E-mail to communicate, I lost my phone in July of 2018, and the backup for Whatsapp, and Viber didn't work, I downloaded the chat history since I got my new phone and to print it out would be over 1500 pages.  We didn't have a reception because we left on our honeymoon the same day as the wedding.  My mind is all a jumble at the moment.

Get a better translation done and submit a color copy (since you mentioned black and white before). The translation should include everything, including what all the stamps and seals say...every last word should be translated.
