Hello experts,

I just started to get to find out about so-called "follow-to-join benefits". See for example:

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

So my situation is this:

  • I arrived at US in 1998 as student (F-1)
  • wife (not married to her then) granted asylum status in 1999
  • wife (not married to her then) applied for AOS to LPR in 2000
  • married to my wife in 2004
  • wife received her green card in Dec 2005
  • wife petitions I-130 for me Feb 2006
  • I-130 still pending and I'm still a student (F-1)

The above link seems to indicate that I should be able to apply directly for AOS using I-485 since we were married before her AOS was approved. Am I reading that correctly? If so, do I still need to wait for the I-130 petition and visa number to become available or is that no longer necessary under the "follow-to-join" umbrella?

Thanks in advance,

John
