Hi, I am US citizen and husband who is CPA is on H1b visa here but due to covid-19 he no longer works so guide what are my options from now onwards as its been told to us that he has 60 days to leave the country, We haven't filed the greencard yet, we were about to do it to change his status but then this happened,

so now what my options are that he stays here.

1. File I-130 & I-485 concurrently, most of people would do this way.

 

2. He leaves and you file I-130, he will be interviewed in his original country.

File the Spousal Visa package and the AOS package together.  Follow the guides here and include the I-944.  Include the "optional" forms.

 

He can stay in the US.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

And don't do the medical yet - do it when they send you a "courtesy letter" closer to the interview.

All in all, the total amount is $1760... 

I-130= $535

I-485+ biometrics= $1225

I-864= depends on the civil surgeon.

 

The rest of forms are free when filing all together.

What is procedure of filing visit visa, for people in living in US already? As my husband is here on H1B but his firm laid him off due to covid-19 now his firm's immigration lawyer has given us an option/advice to file for visit visa by the end of his 60 days grace period if in the meantime no new employer sponsors him again, 

so once he files for his visit visa his stay in US becomes legal and he can continue his job hunt here n get H1b

 

kindly guide me through visit visa process, Thankyou
